– The verdict had long been announced and the reasons were explained – judge Christian Lederhofer said: “Family therapy would probably also be appropriate.” He said that to a woman from Freising (56), who took part in the hearing on Monday before the district court’s lay judges as co-plaintiff had participated - and it was addressed to the defendant, her son.
The public prosecutor had charged the 31-year-old from Landshut with a range of crimes – all of them had been committed to the detriment of his mother, whom he only referred to as “Ms. K.” during the hearing.
The accused: "I was about to die"
Nevertheless, the 31-year-old attributed the crimes to his drug addiction.
"I was about to die," he replied when asked by the judge about his condition at the time of the crime.
The lay judge finally sentenced the man from Landshut to a term of imprisonment of one year and ten months for bodily harm, threats, insults, trespassing, theft, property damage and violation of the Violence Protection Act.
Defense attorney's request for a deferral of sentence in favor of therapy was granted.
In addition, the collection of compensation for lost value in the amount of 830 euros was ordered.

Between December 2020 and October 2021, the 31-year-old consumed drugs "uncontrolled and randomly", above all heroin, as he himself admitted.
Since the age of 19, addiction has had a merciless grip on him.
The 31-year-old repeatedly broke into his mother's home
As far as the charges are concerned, according to the 31-year-old, he largely no longer knows what he is being charged with.
The defense attorney had already fully admitted the facts on his behalf after reading the indictment.
His client regrets his "excesses" very much.
But he didn't want to apologize to his mother.
The 31-year-old had entered their house in Freising several times.
Once he forced open a basement window and stole the car key for the BMW, a laptop and a chain from his mother.
Another time he had smashed the glass pane of the front door.
The defendant even threatened his mother with death
He then stayed in the apartment for several days in his mother's absence.
When the 56-year-old did not open the door for him in another case, he kicked it in, grabbed his mother by the shoulder and pressed it against the wall.
He had verbally abused her and threatened her with death.
The public prosecutor had asked for a prison sentence of two years, the defense one and a half years.
A suspension of probation was no longer an option with 13 previous convictions.
