Energy: the CLCV launches a class action against the supplier Mint

Mint Energie is accused of having imposed on customers a less advantageous electricity offer than that which they had subscribed to.

The consumer defense association CLCV has announced that it is launching a class action against the electricity supplier Mint Énergie, accused of having imposed on customers an offer less advantageous than the one they had subscribed to.

"

The facts in question relate to the replacement in November by the company Mint of an electricity supply indexed to the evolution of the regulated sales tariff by another supply indexed to the monthly average of the wholesale market

", explains in a press release the CLCV, which indicates that it has launched this action with the Montpellier court.

This change was made “

without the express prior consent of consumers

,” she said.

The association estimates the damage at several hundred euros for many customers of the small supplier.

"

Several tens of thousands

" of consumers are concerned, told AFP François Carlier, the director general of the CLCV.

Prices on the wholesale electricity market have indeed soared for several months, a trend exacerbated more recently with the invasion of Ukraine by Russia.

On the other hand, the increase in the regulated sales tariff (TRV) was limited to 4% this year by the government.

It is EDF (in addition to a few local companies) that sells contracts at the regulated tariff, but many competitors index their own offers to it.

"Very great weakness of the action of the State"

The Energy Ombudsman received a record number of disputes last year, he said in his annual report in May.

Mint Énergie was among the worst performers, with a litigation rate well above average.

Mint Énergie, launched in 2017, is a brand of Mint (formerly Budget Telecom), based in Montpellier.

The CLCV had already launched a group action in March against two subsidiaries of the Casino group, CDiscount and GreenYellow, accused of harassing customers to give up an advantageous fixed-price gas offer in return for a modest compensation.

In a context of soaring energy prices, the association also draws a more general assessment on Wednesday of the monitoring of the functioning of the retail markets by the State, accused of looking “

elsewhere

”.

"

It is with bitterness that we were able to note the very great weakness of the action of the State to protect consumers

", writes the CLCV.

In particular, she criticizes the administration for having allowed dozens of virtual operators to enter the market without checking their solvency and for not sufficiently suppressing unfair practices.
