The district of Miesbach blames the association for the protection of the mountains for the loss of the landscape protection areas.
This causes outrage.
The SGT demands an apology.
Tegernseer Tal/district
- The end of the six large landscape protection areas (LSG) in the Miesbach district will probably be sealed as soon as the Munich Administrative Court presents its written justification for the Saurüsselalm judgment.
So much for the facts.
The fact that the district office shifts the responsibility for this to the Association for the Protection of the Mountain World, which, despite the corresponding warning, has maintained its lawsuit against the conversion of the Wiesseer Alm, is not only responsible for the association itself, but also for the Tegernseer Tal Protection Association (SGT). "great surprise" and "outrage".
SGT wants public apology to mountain protection association
The district itself, the SGT writes in a statement about the loss of validity of the LSG regulation, "caused this scandalous grievance through inexcusable failure".
In a letter to district administrator Olaf von Löwis and press officer Sophie Stadler, SGT Vice-Chairman and Tegernsee Green City Councilor Marcus Staudacher asks for a public apology to the Association for the Protection of the Mountains.
In addition, the valley protectors call for "a temporary safeguarding of the status quo until a new, legally secure LSG ordinance comes into force".
Furthermore, we reserve the right to take legal action.
Protection community accuses the district of sloppiness
After the district office took the association for the protection of the mountains to court, the protection community is not afraid to speak out clearly.
The fact is that the district office “sloppy” the original maps and did not log a crucial district council decision to secure the LSG regulation.
In addition, there is the legal opinion that a general building ban in the LSG is not compatible with current law.
"Instead of apologizing for their sloppiness, the buck is now being passed to a nature conservation association with integrity," the SGT angrily says.
Saurüsselalm: SGT speaks of omissions by the district authority
The association also finds that the district office, as the approval authority, should have resolutely opposed the "unlawful activities" of Saurüssselalm owner Franz Haslberger much earlier.
The authority has not fulfilled its obligations in many respects, says the SGT, citing the dance floor and the awning as examples, which are clearly "black buildings".
In addition, the number of approved seats was not adhered to, the public concerns of species and nature conservation were not taken into account.
Furthermore, the protective community writes: "The illumination of the entire surround is illegal."
