Schongau - A decision regarding the bathing island and the bathing jetty at the Schongauer Lido was not made by the city council's one-and-a-half-hour on-site visit on Tuesday.

The discussion and arguments for and against deployment remained largely the same.

A decision should finally be made next Tuesday.

Some city councilors were unable to attend the on-site meeting at the Lido on Tuesday afternoon.

Mayor Falk Sluyterman justified the unusual time by saying that the jetty and island had to be deployed first, but also had to be out of the water again on the same day.

"We needed a certain lead time," said the mayor.

The guidelines of the Bavarian State Ministry of Justice provide a risk analysis not only of the jetty and island, but of the entire bathing area, explained manager Bettina Schade again in the town hall.

The problem, however, is that according to the legal opinions that have been carried out, these guidelines are not binding.

"It is not foreseeable how a court would decide in an emergency," summarized Schade.

An exemption from liability only applies to natural hazards, Schade continued.

"This does not apply to artificial facilities," she clarified.

In addition, the question should be asked whether a stranger would expect a lifeguard here.

After all, there are various incentives in the lido area, including changing rooms, toilets, showers, loungers, etc. Schade mentioned. "But we can't really judge this question," Schade told the city council.

Added to this are the dangers of swelling operation.

This has increased in recent years, according to the city forester Klaus Thien.

The water level changes several times a day.

The flotsam is also apparently increasing.

Some of this has already gotten stuck on the bathing island, Thien continues.

"There are dangers that are not easy to spot," says the city forester.

Also because the water has become cloudier due to the swell and you can no longer see as far.

He also observed: "Many think this is a lake."

So far, the two facilities have been checked twice a week by the building yard, according to Thomas Ola from the city building department.

But only superficially.

In the meantime - 2019 - however, the manufacturer has also tightened its information.

His conclusion from this: "We would have to check almost every day," says Ola.

And that too under water.

It looks similar for the jetty, so Schade, although the dangers there are probably not quite as great as on the island.

For an accurate assessment, however, one must consult an expert for a detailed risk assessment.

She once again referred to the individual sources of danger: swell operation, storms, waves, the distance of the island from the shore at 65 meters.

In addition, children or drunk people who use the island must also be expected.

A check to ensure that nobody dives under the island or whether the permitted number of 25 adults on the island is observed is impossible.

"The danger is obvious," said Schade.

Markus Keller (Greens) was of the opinion that flotsam could get stuck anywhere.

In addition, the not far away Lech raft, which is currently there, and the jetty of the water rescue service could also offer an incentive.

"But this is not an artificial facility, but a natural hazard," said Schade to the flotsam.

And that's where a court comes in.

At the jetty of the water rescue service, one is out, according to Mayor Falk Sluyterman.

When it came to the Lech raft, he agreed with Keller: "You have to think about that again."

Marianne Porsche-Rohrer (CSU) wanted to know whether there was no diving club in Schongau that could be involved.

The use of volunteers is difficult here, says Sluyterman.

When using divers, who would have to check this almost every day, the head of the town hall referred to the costs.

After all, not far away is the Plantsch, which offers all this and runs a deficit of around one million euros a year.

"It's getting out of hand in the truest sense of the word," says Bettina Buresch (Greens) on the new aspect with the divers.

"Where do you start and where do you stop on the river bank in Schongau?" She recognized further sources of danger.

"The bathing island is dead for me," said Martin Schwarz (SPD).

However, the jetty could perhaps remain.

There is also more social control here by other Lido visitors.

He advocated treating the jetty and island separately.

"We can't leave the island in like this," said Gregor Schuppe (ALS).

He suggested having the whole thing examined by a specialist company.

"After such an expert opinion, we would also have a handle," says Schuppe.

Ilona Böse (SPD) wanted to know what such a risk analysis would cost.

Ola expects around 4,500 euros here.

The lawyer's report has already cost the same.

"I'm not willing to waste another 4,500 euros," said Böse.

No one commits themselves, personal responsibility is undermined.

On the other hand, Thomas Schleich (UWV) also advocated taking the money into your own hands.

"I'm not willing to take the risk," Porsche-Rohrer said very clearly with regard to liability.

She is also of the opinion that the city forester can assess the risk of driftwood better than an external expert.

“Would the loss really be that big?” interjected city master builder Sebastian Dietrich.

After all, there are also many citizens who visually disagreed with the jetty and island.

No decision was made at the special meeting.

It should now take place in the city council meeting next Tuesday, June 28th.

This will take place from 7 p.m. in the Jakob-Pfeiffer-Haus.
