Starnberg – Mayor Patrick Janik had already announced it at the end of March.

When the city council rejected an ordinance banning alcohol for public areas at the time, it brought up a kind of house rule for the municipal bathing area.

"I think that bathing and alcohol don't get along" - nothing has changed in this opinion since then.

And so Janik and the city administration presented the main and finance committee with a draft of a green space statute on Monday evening.

This again includes a ban on alcohol, but this time limited to the municipally owned bathing areas, i.e. the Steininger and Böhler properties.

Alcohol will be banned there around the clock.

The same applies to glass bottles, glasses and other glass containers.

It is his "deepest conviction" that the large number of pieces of broken glass creates a special risk for people who walk barefoot there, said Janik.

"We have a problem there and need a solution."

As in the spring, there was an extensive discussion this time too.

"We are punishing the masses of citizens with this," Michael Mignoli (BLS) criticized the alcohol ban.

Anyone who treats themselves to a shandy or a Prosecco is not immediately an alcoholic.

It would be more effective for the security service to single out individuals who are going too far.

"Then it was done after three weeks," said Mignoli.

Janik saw this as an act of arbitrariness, against which one could complain wonderfully.

Ludwig Jägerhuber (CSU) made a similar statement to Janik, but at the same time warned against a block warden mentality.

"That's the compromise we wanted," he said.

Kerstin Täubner-Benicke (Greens), on the other hand, went too far with the draft, and Raphael Felber (WPS) also rejected the ban.

In the end there was still a 6:5 majority for the alcohol ban.

The vote for the glass ban ended 7:4.

Here, too, there was criticism from Mignoli (“that goes too far”) and Täubner-Benicke (“I think it is exaggerated”).

Thomas Beigel (CSU), on the other hand, spoke out clearly in favor of the ban.

In many countries around the world, glass is already banned on beaches where people walk barefoot.

"These countries are showing us how," he said.

"Instead, you can simply use reusable plastic items," added Marc Fiedler (FDP).

Green space statute comprises six pages

The green space statute comprises a total of six pages and 16 paragraphs.

It contains, among other things, a leash requirement for dogs and a total of 14 prohibitions.

And it regulates exceptions and penalties for violations, ranging from being sent off to fines of up to 2500 euros.

All "urban meadows with a bench on them" are considered green areas, as the head of department Ludwig Beck explained in simplified terms, i.e. in addition to the bathing areas, for example, the Bucentaurpark and the Almeidawiese.

However, the last word has not yet been spoken.

In the end, the committee recommended the entire statute with nine yes and two no votes (Täubner-Benicke and Annette Kienzle, both Greens).

However, the decisive vote will not take place until next Monday, June 27, in the city council.

The public part begins at 6.30 p.m. in the multi-purpose hall in Wangen.

Paragraph 3 of the draft statutes, which was approved by the main committee with a 9:2 vote, states: "In the green areas, users are particularly prohibited from:


- soiling green areas and their facilities, in particular by throwing away or leaving objects behind or by not removing dog excrement,

- the causing of impermissible noise, in particular the playing of music, which is likely to cause serious annoyance to others or damage to the health of another,

- musical performances of any kind,

- the consumption of alcohol in the bathing areas,

- Staying in all green areas, parks and playgrounds while intoxicated, insofar as this causes more than unavoidable annoyance to others,

- defecating outside of the facilities provided for this purpose,

- smoking and drinking alcohol on playgrounds,

- operating open fireplaces, with the exception of designated barbecue areas, and burning torches,

- the carrying of glass bottles, glasses or other glass containers on the bathing areas,

- camping and setting up pavilions as well as spending the night in the facilities,

- the sale of goods of all kinds, including food and beverages, the offering of commercial services, filming and photography for commercial purposes (commercial recordings from private life such as weddings and the like are excluded) and the organization of entertainment,

- the erection or attachment of fixed or mobile structures,

- entering flower and other decorative plantings,

- the spreading of fodder and food.”

City council still needs to approve the entire bylaw.

The topic is to be finally discussed in the meeting next Monday, June 27th.
