Working time of public officials: the showdown continues

Four communist town halls have seized the Constitutional Council for not having to respect the law of 2019.


On the numerical level, we no longer know where we are and even the Ministry of the Public Service seems to have trouble keeping the count... More than six months after the entry into force of the obligation to pass their agents working 35 hours a week (1,607 hours a year), several dozen local authorities still do not comply with the 2019 law which requires it.

A setback linked to the health crisis for some, more complicated negotiations than expected for others.

It must be said that the new regulations often oblige agents to return several days of leave which they benefited from by way of derogation from the Aubry laws of 2001.

Communities always have more agents

But for the most refractory, the positioning is above all political.

This is particularly the case for the four communist town halls of Val-de-Marne which are now asking the Constitutional Council to decide.

The councilors of Bonneuil-sur-Marne, Fontenay-sous-Bois, Ivry-sur-Seine and Vitry-sur-Seine had already distinguished themselves in February…
