U.S. Supreme Court Justice Clarence Thomas said today (Friday) after reversing the precedent-setting ruling Roe v. Wade that other precedents regarding gay rights and contraception should be considered now.

Thomas wrote that those rulings "were wrong."



The Supreme Court today denied the right to a safe and healthy abortion to all women in the country, enshrined in law in a 1973 ruling, and transferred the decision to individual states.

The cases Thomas mentioned are Griswald v. Connecticut from 1965, in which the Supreme Court said that married couples have the right to obtain a share capital;

Lawrence v. Texas, 2003, established the right to get engaged in private sexual ceremonies;

And ruled from 2015 in Obergafel against Hodges, where he said there is a right to same-sex marriage.



Recommendations to reconsider these rulings have no legal force, nor do they oblige other judges to follow them.

But it is an invitation to conservative legislators in individual countries to enact laws that may be contrary to historical rulings, and in the future perhaps even to their reversal.



Thomas wrote today in an opinion that he is in favor of the conservative judges in the vote against Roe.

"The Court has well explained why, under our extensive precedent proceedings, the right to abortion is not a form of 'liberty protected by a proper procedure clause in the 14th Amendment to the Constitution.'

The section ensures that no state will be able to "deprive any person of life, liberty or property without proper due process of law."



Thomas argued that the right to abortion under the clause "is not too deeply rooted in the history and tradition of this nation" and is not "implied in the idea of ​​protected liberty."

He noted that the three cases now need to be reconsidered.



Thomas said today's ruling on Roe v. Wade "should not affect other non-abortion precedents ... but in the future, we must consider all of those precedents. We must correct those mistakes."
