2022-06-26T12:44:15.487Z

The experiment at the science fair resulted in the injury of three children who came to watch the event • The court: "The accident is the result of blaming the place of actual and ongoing negligence, ignoring the safety issue and lack of exercise of basic safety judgment."

The experiment at the science fair caused damage to students:

ORT principals, Sharona Calderon, Smadar Or and Ran Sofer were accused of recklessness, negligence and sabotage.

Also, producer Gilad Bayo and safety engineer Solomon Texir, were charged with sabotage and negligence, following an incident that occurred during which burns and serious injuries were inflicted on three minors, who took part in a "science fair" produced in Rabin Square by the ORT network.

The court ruled that Sharona Calderon, the director of the incident, did not pay too much attention to safety and was therefore sentenced to two months of service and compensation in the amount of NIS 45,000 for each of the two injured children and another NIS 7,000 in compensation to the third child.

Smadar Or did not exercise any safety discretion and was therefore sentenced to three months of service work and another NIS 60,000 for the two children and NIS 10,000 for the third child.

Solomon Texir, the head of incident safety as the safety engineer, fundamentally failed in his job as safety manager and was sentenced to three months of service work, NIS 60,000 for both children and NIS 10,000 for the third child.

Gilad Bayu and Ren Sofer received two months of service and compensation of NIS 45,000 for the two children, and NIS 7,000 for the third child.

In total, all the defendants together will pay NIS 584,000 to the three victims.

"Nearby Culture"

According to the indictment, the three boys took part in the Israeli Science Day event that took place in Rabin Square in Tel Aviv in 2014, at the initiative of the Ministry of Education and in the production of the ORT network through the producer and safety engineer.

As part of the fair, it was decided to hold and carry out a "boat experiment".

This experiment included the use of fire and booze to propel a boat, and despite the risk, the defendants failed to properly train the performing students, keeping the experiment rules in particular and required safety in a mass event as a whole, ignoring the fact that this experiment was disqualified from public use a year earlier.

Lack of this safety judgment led to the fact that on the day of the incident, visitors stood next to the table where the experiment was conducted and during one of the demonstrations, one demonstrated an additional amount of flammable material which led to fire holding three minors who came to watch the experiment. To the hospital for their hospitalization and medical treatment, in fact to this day.

The defendants all had a connection to the activity in the incident in which the accident occurred.

Some are related to the organization, production, management and safety of the event.

Some of them are related to the content, activities and experiments that were presented at the event and to the ORT students who presented them. "

The court also ruled that this was high-level negligence and this was beyond the clear error of the minor student who presented the experiment that caused the unfortunate accident.

"The accident is the result of blaming real and ongoing negligence, ignoring the safety issue and lack of basic safety judgment on the part of those responsible for the event and those responsible for the content of the activity and the students presenting, lack of understanding and familiarity of those responsible for the event and safety. "Ignore the warning lights that were lit in a bright light in relation to the safety risks involved in presenting the experiment," Judge Gat wrote, adding in the verdict: "This is an incident of" neighboring culture " By minor students is not dangerous and whatever, in any condition and circumstance and in the form of "blind reliance" on the actions of those responsible without a basis and justification for it,

At the end of the verdict, Judge Gat noted at the time: "None of the defendants chose to take responsibility, even general administrative responsibility, for the unfortunate accident and the serious injuries caused to the children of the victims. None of them even expressed real empathy for the children." .
