The appointment negotiation went better for golf club manager Urs Zondler.

Beuerberg/Wolfratshausen – Out of anger that she had given him the right of way, he overreacted and forced a woman on the road.

The District Court of Wolfratshausen therefore now sentenced Dr.

Urs Zondler (83), founder and manager of the golf club in Beuerberg, in January to a fine of 50 daily rates of 200 euros (10,000 euros).

He was also given a one-month driving ban.

He didn't want to let that sit on him.

The businessman and doctor of law appealed.

It was about the driving ban and a lower fine.

Now the proceedings before the Munich II Regional Court have been rolled out again.

At times there was a discussion about social justice.

Zondler and his defense attorney Stephan Tschaidze did not dispute the act itself.

They recognized the guilty verdict from Wolfratshausen.

According to this, the native Swiss was driving his Audi Q5 on May 15 last year on Grundstrasse and Königsdorfer Weg in Geretsried.

Meanwhile, a VW driver is said to have given him the right of way by turning just in front of him.

Zondler says he had to swerve, hit the underbody and thought something was broken - which it wasn't.

When the woman turned onto Jeschkenstrasse, he overtook her, cut her and braked her.

She had to brake sharply.

He got out again, went to her and scolded loudly.

The woman spoke of a "choleric tantrum" that scared her and her six-year-old son very much.

She went to the police.

Zondler apologized to the VW driver on the spot.

At the district court, he said: "I'm not proud of how I reacted.

I have made a mistake."

Restaurateur and sports field operator - "He has no income"

However, the district court assumed far too much income, said Zondler.

Since the pandemic, he has had no income and only a loss.

In order not to have to lay off the employees, he took out a large loan.

In addition to the golf club, he also has a business near Stuttgart - and a total of 100 employees.

Every cent that is now collected goes to the bank.

"He has no income," emphasized the defender, "he lives on assets".

He did not want to name the amount in the presence of the press in the courtroom.

The assets should not be counted anyway, since it is a matter of old-age provision, he said.

The chairman disagreed: "The economic living conditions may be taken as a basis."

Court reduces fine for 83-year-olds

Zondler and Tschaidse did not give up.

The district judge did not take note of “that Covid has meant significant losses for me as a restaurateur and sports field operator,” said the Beuerberger.

"I used to be a very wealthy person, no question, but two years of Covid set me back a lot." The 83-year-old also attacked the driving ban.

"It gives me so much burden." Despite his problems with walking, he had to travel for hours by public transport to Munich and Stuttgart.

But the judge refused to be talked to.

It is only a one-month driving ban.

"It's not even a driver's license suspension.

You could have thought about it well.” Of course, there was his age and a certain reliance on driving.

"But this is no worse than in other cases."

The chairman drew a comparison with other defendants.

There are, for example, package drivers who cause an accident under stress and flee.

These people would earn 1500 euros and face considerable difficulties.

You would have to feed the family.

And the driver's license withdrawal is threatening their existence.

"That hits her much harder than Dr.

Zoners,” he said.

He could pay a taxi.

So the driving ban remained.

However, the fine was somewhat reduced – to 50 daily rates of 140 euros each.

That's 7000 euros.

"That certainly doesn't overstretch him to his detriment."
