The story has its roots in a property deal that the municipality of Fischbachau sealed almost ten years ago: the owner of a meadow, into which the two cul-de-sacs of Maierfeldstraße lead, hands over his property to the municipality – and receives another area in exchange.

The goal of the municipality: to connect the dead ends on the meadow with a ring closure.

But it is unclear whether this will ever be built.

Therefore, the landowner agrees that he can buy back his meadow if the community does not build the ring road in the next ten years.

This was not decided publicly by the municipal council, says Mayor Stefan Deingruber (CSU).

Municipality wants to avoid disadvantages of dead ends

Sebastian Wittmoser, one of the residents of Maierfeldstraße, reports: "Suddenly the excavator arrived." And that although the street had not been used by anyone in the past ten years.

The construction was against the will of the citizens - and "a quick hit without the promised involvement of the residents".

With the ring closure, Wittmoser fears dangerous through traffic: "Children play on Maierfeldstrasse:" Residents could also face development costs - and the surface sealing is "unnecessary".

The resident suspects another goal behind the construction: "An unnecessary road is being built just to secure the property."

The former owner of the meadow, who does not wish to be named, shares this opinion.

He says he would have been willing to negotiate with the municipality: "I could have bought the property back at a higher price, or they could have negotiated an extension of the period after which the right of repurchase applies." But: "No one is on me approached to seek a joint solution.” The fact that a road is now being built “that nobody actually needs” is not in the interests of the citizens.

Instead of looking for solutions, the road is only built "to be able to keep the property".

Deingruber, on the other hand, reports that the previous municipal council already considered the ring closure to be necessary.

"He dealt with this topic in detail at the time and wanted to avoid the disadvantages of dead ends such as in the Lehenpoint and Maierfeldstraße development areas," says Deingruber.

The current municipal council unanimously confirmed this position after the situation had not changed.

The decision was made in camera, “because it was about contractual relationships relevant to data protection law”.

Mayor was aware of "trouble and difficulties" for the community

The new Mayor of Fischbachau explains why the road is only being built now, shortly before the deadline, "after consulting the administration": "In an earlier meeting with the residents, there was a desire for a cheap solution with lower development and construction costs. “No such offer was received.

The municipality also offered a minimum expansion within the legally permissible scope - with development contracts instead of contribution notices.

"However, no use was made of it." In the years that followed, the topic "was no longer pursued with political emphasis", but was included in the budget every year.

“There has always been a will to implement it,” emphasizes Deingruber.

As part of a certification, the building authority was then informed that the period of time until the right of repurchase came into force was running out.

"It's the job of the administration to point out to politicians when something happens that no longer guarantees the implementation of municipal council decisions," says Deingruber.

He had to inform the municipal council about the deadline – even if the matter was associated with “trouble and difficulties” for the community.

He was well aware of that beforehand.

Municipality secures "opportunity to expand road" for 31,500 euros

While residents suspect that the community is only concerned with the property, Deingruber says: "There is currently no planned construction area there." There are also "no efforts" by the community to develop areas there.

The ring closure is currently being built as a gravel road.

Development costs would only be incurred by the residents once the building has been fully expanded.

"The municipality thus secures the possibility of expanding this road later." The costs: 31,564 euros.

This tax money would be better spent elsewhere, comments Merkur employee Jonas Napiletzki.
