Zhang Daming, chief lecturer at the Faculty of Law of the University of Hong Kong, is accused of releasing internal documents of the Law Society without authorization during his tenure as a council member of the Law Society in 2020.

The Council passed a motion of no confidence in Zhang, referring the matter to the Solicitors Disciplinary Tribunal.

Zhang questioned the council's actions, believing that it violated established policies and procedures and was unfair. On Friday (24th), he submitted a judicial review to the High Court, requesting that the decision be overturned.


The applicant Zhang Daming, the respondent, the Council of the Law Society of Hong Kong, and the Solicitors Disciplinary Tribunal were listed as interested parties.

Zhang Daming pointed out in the application that the then Legislative Council member Kwok Wing-keng stated in March 2020 that he had contacted the Bar Association and the Law Society of Hong Kong, requesting the two associations to consider financial support for barristers with less than 5 years of experience and small and medium-sized law firms respectively.

One of the standing committees of the Law Society held a meeting, pointing out that Guo Wei did not formally contact the Law Society about the proposal, thinking that the then president Peng Yunxi should ask Guo for clarification.

Peng sent a letter to the directors of the Law Society on the 27th of the same month, and sent it to the members on the 30th of the same month.

It was accused of forwarding the letter from the president to Guo Rongkeng

Zhang, who is a director, received the letter on the 27th and sent it to Guo.

Later, during the meeting, the Council of the Law Society discussed Zhang’s privately forwarding the letter to Guo. Zhang apologized to Peng via WhatsApp after the meeting, but the Council of the Law Society passed a motion of no confidence against Zhang in Zhang’s absence. .

In addition, in May of the same year, the Law Society issued a press release on the election of the internal council.

Zhang issued a press release on Facebook saying that the Law Society's board of directors "passed by a large margin" and that all directors should be held accountable, even if they have different views.

Law Society sets up independent panel that Zhang violated the law

The Council of the Law Society later set up an independent group, and after investigation, it was found that Zhang, as a director, violated the duty of confidentiality.

The Council referred both cases to the Disciplinary Tribunal in April 2021.

Zhang believes the practice deviates from public policies and procedures

Zhang questioned that the Council did not refer the incident to the Investigation Committee or the Standing Committee on Review and Discipline, which deviates from the published policies and procedures.

Zhang also questioned that the current practice of the Council is unfair and biased.

He therefore asked the court for an order to overturn the decision referred to the Solicitors Disciplinary Tribunal and to stay the proceedings of the Tribunal pending the outcome of the judicial review.
