The petitions committee of the state parliament took the illegal buildings in Wolfratshausen off the agenda at short notice.

Wolfratshausen/Munich – On Wednesday morning, the committee for petitions and complaints of the Bavarian state parliament wanted to deal with two petitions relating to illegal buildings on the Isarspitz in the Weidach district of Wolfratshausen.

But the topic was taken off the agenda at short notice, according to the rapporteur on the committee, CSU member of parliament Benjamin Miskowitsch from the Fürstenfeldbruck constituency.

There are still some "open points of agreement" between the district office in Bad Tölz and the city of Wolfratshausen, Miskowitsch explained to our newspaper when asked.

These are "very important points" with regard to the opinion of the Petitions Committee.

As reported, the committee was approached by the owner of the three single-family houses – and also by a family of six who rented one of the properties.

After the lower building control authority at the district office had classified the houses as illegal buildings and insisted on their demolition, the client complained to the petitions committee about the district authority.

At the same time, the man from Geretsried tried to get a building permit with the help of the Munich Administrative Court - the 1st Senate of the Bavarian Administrative Court rejected the request in the last instance, as reported.

With regard to the petition process, the Bavarian state government was asked to submit a statement on the Isarspitz case.

According to Miskowitsch, this statement remains under wraps.

According to information from our newspaper, the Söder cabinet proposes that the city of Wolfratshausen subsequently have a development plan drawn up for the properties at Isarspitz 24, 24a and 25, which are located outside.

In this way, what was previously not permitted could be legalized.

Mayor Klaus Heilinglechner and most of the city councilors categorically reject this.

And the district building office?

This is confirmed by the decision of the Bavarian Administrative Court in its legal opinion and insists: The owner must demolish the three houses by October 1st.

If he does not voluntarily follow this request, the district authority will issue a "removal decision," announced the press spokeswoman for the district office, Marlis Peischer.

Now, however, the 14 members of the state parliament from the CSU, Free Voters, Greens, SPD, FDP and Afd are the first to vote.

"After the parliamentary summer break," announces rapporteur Miskowitsch, the illegal constructions on the Isarspitz should be back on the agenda of the petition committee.

Until then, the district office and municipality have the opportunity to answer open questions.
