In view of the specificity of the tourism sector and its different nature from the nature of commercial work and the necessity of making the necessary amendments to the provisions of Law No. 2 of 2013, President Bashar al-Assad issued Law No. (28) of 2022, which includes amending some articles of Law No. 2 of 2013 on in the tourist registry.

Below is the text of the law:

                                 Law No. (28)

President of the Republic

Based on the provisions of the Constitution

And on what was approved by the People’s Assembly in its session held on 23/11/1443 AH corresponding to 23/6-2022 AD;

It issues the following:

Article (1) The following paragraphs shall be added to Article (2) of Law No. (2) of 2013:

6- The tourist registry replaces the commercial registry with regard to the sites of tourism work and the sites of companies subject to the provisions of this law.

7- The touristic character of the tourist work sites and companies subject to the provisions of this law shall not be considered before the courts and public authorities, and their claim or review shall not be accepted in this capacity unless they are registered in the register.

Article (2) Article (5) of Law No. (2) of 2013 regarding the tourism registry is amended to become as follows:

1- Tourist work sites and companies will be fined (1000000) SP one million in the event that an application for obtaining the record is not submitted, accompanied by the supporting documents specified by the executive instructions, within 30 thirty days from the date of obtaining the necessary license.

2- Tourist work sites and companies will be fined (250,000) SP two hundred and fifty thousand Syrian pounds in one of the following two cases:

A- Not to make compulsory entries and amendments to its record within 30 thirty days from the date of issuance of the document to be registered. As for judicial rulings and decisions, its registration begins from the date of its issuance, gaining a final degree.

b- Failure to mention the number and location of the record on its correspondence and publications, or the incorrectness of the data provided by it to obtain the record.

3- The data recorded on the register shall be effective against third parties as of the date of its registration.

4- The fines stipulated in Paragraphs 1-2 of this Article shall be doubled, and the site shall be closed for a period not exceeding three months in one of the following two cases:

A- Failure to pay the fine within a period of 15 fifteen days from the date of organizing the seizure.

b- Repeating the violation.

5- By a decision of the Minister, a number of permanent employees of the first and second categories in the ministry and its directorates in the governorates are assigned to monitor the implementation of the provisions of this law.

“I swear by God Almighty to carry out my mission honestly and faithfully.”

6- The Minister shall issue the decisions of fines and closures stipulated in this Article.

Article (3) This law shall be published in the Official Gazette.
