Black constructions also occur again and again in the communities - albeit not as blatantly as on the Isarspitz.

The mayors understand the hard line of the building authority.

– The fact that three single-family houses on the Isarspitz in Wolfratshausen are to be demolished because they are illegal buildings has been a source of excitement for weeks.

But it doesn't always have to be such spectacular cases.

Anyone who accompanies local politics in the district knows that the city and municipal councils always have to deal with larger or smaller buildings that were never approved in this way.

Münsing's Mayor Michael Grasl first refers to the responsibilities.

"Clandestine buildings are an issue for the district offices as soon as they become known as such." This is important to know, because many citizens are not aware that the building authorities in the district office have the last word.

In Münsing, too, there are always cases that have to be treated a second time.

According to Michael Grasl, "the processing times due to administrative procedures and legal remedies are too long".

The district office always has the last word in building matters

Basically, the Münsinger town hall boss thinks that a clear line must remain visible, because otherwise there will be reference cases.

In his capacity as a former head of the building authority, he says: "In our location, with our property prices and so many coveted areas, the municipalities and district office must not let themselves be played off.

Otherwise the decent citizen loses his faith.” In the Wolfratshausen case, Grasl is one hundred percent behind the district office and the city.

"The fault lies with the developer and not with the authorities, even if that is bitter for the tenants."

The municipality of Egling also has to deal with what is commonly referred to as “black housing” on a regular basis.

"The prime example is a wooden floor that was attached to a garage at some point without permission being given," explains Mayor Hubert Oberhauser.

Nobody notices this for a long time - until larger planning is pending and the difference to the first approval becomes obvious.

"Something like this happens every two or three meetings," explains Oberhauser.

There was a real uproar in Egling

In general, a pragmatic solution is sought.

But there are also other cases, such as agriculture on the Ludwigshöhe.

There the man had committed too many violations for the municipal council to agree.

In a meeting in 2019, there was a scandal.

However, the farmer subsequently managed to obtain agricultural privileges.

He was right, halls and draws remained.

The Mayor of Eurasburg, Moritz Sappl, says with a view to the Isarspitz: "We don't know such dimensions here." If so, then it's about little things like a dormer window.

In Sappl's opinion, this also has to do with the fact that you pick things up faster in a small community than in a large city.

"There is no better building inspector than the direct neighbor." With a view to Wolfratshausen, he says: "The building law must be observed.

There are simply limits that have to be respected.” He understands the hard line of the district office.

Stricter professional rules for architects?

Dietramszell Mayor Josef Hauser explains for his community: "We have not had such serious cases as in Wolfratshausen." Therefore, general statements could not be made.

The building committee decides on minor offenses à la dormer.

There was only a larger surcharge in 2013, when the building committee announced that it would take tougher action against building sins.

The district office had previously suggested to the then head of the building authority and the former manager that they should also initiate administrative offense proceedings.

"Yes, yes," replies Mayor Verena Reithmann.

Every few meetings, the ward council has to deal with such cases.

"Then they like to say that the construction had been optimized," said the head of the town hall.

"Of course, that's always a nuisance for us." Reithmann would like the architects to have stricter rules of conduct.

"That has not been the case until now."
