Tel Aviv Magistrate's Court Judge Dana Amir today convicted Eliezer Dalal, one of the owners of the "suffering" pizzeria, of committing three offenses of indecent assault on three complainants, two of whom were minors at the time of the incident.
During 2019, an indictment was filed against the defendant, in which it was alleged that the defendant approached the complainants, started talking to them and offered them to enter his pizzeria.
During the complainants' stay in the pizzeria, the defendant committed indecent acts on them, and did not stop doing so even after they expressed to him their disagreement with these acts and their desire to leave.
In the verdict, Judge Amir ruled: "Along with my direct impression of the credibility and authenticity of the complainants' version and the evidence that supports it, in terms of their version, it also appears that there is a great and similar resemblance between the defendant's actions described by each of them." Passing near a pizzeria, the defendant made a remark to them regarding their self-confidence in order to attract their attention, and as a result they entered the pizzeria with him.
"During the meeting at the pizzeria, the defendant began to touch the complainants by means of a massage. After expressing opposition to his actions and reflecting in his face that the touch was unpleasant, the defendant walked away and cut off contact, but then touched the complainants over their clothes, chest, abdomen and buttocks. "After the incident, the defendant told the two complainants not to tell anyone about it ...".
As stated, the court accepted the prosecution's position while rejecting the defendant's allegations, which among other things claimed that someone was making him a "Little Red Riding Hood" and that there were omissions in the investigation.
