Opinion | These are the defense arguments expected in response to the testimony of Hadas Klein Israel today

2022-07-05T19:47:35.487Z

The testimony of Milchen's assistant opened the case with all cheers. • Defense attorneys will claim that Netanyahu relied on the advice of the late Adv.

The 1,000 case was opened today with a standing ovation in the testimony of Hadas Klein, who was never one of Netanyahu's men, and never spoke to him.

According to her, she testifies out of good citizenship and as such - it is likely that the court attached great importance to her words and accepted them as credible. Her testimony did not make "assumptions" for Netanyahu. Analyze Netanyahu's expected claims against her version.

Netanyahu claims that in receiving the gifts he relied on advice he received from the late Adv. Weinroth.

According to the claim, there was a true friendship between the Milchans and Netanyahu and therefore the gifts are all allowed. Relying on an attorney's opinion can serve as an effective defense, as long as it meets several conditions.

The advice should be given in writing, to be done by an attorney who is an expert in the subject who knew all the facts.

The late Weinroth did not write his opinion - but gave it in his great wisdom in a television interview before his death. It seems that this is enough to meet this condition. Another, is whether these are gifts given voluntarily by the giver, or requests / demands for the gift - in which case it may not be possible to rely on his opinion, since these are not gifts at all.

Defense attorneys will also try to show that these are not such large sums, but much less.

To the extent that these questions are divided in the years (2011-2016) in which the affair deals, it will be argued by them that the "Public Service (Gifts) Law" should apply and not the offense of breach of trust.

Such a conviction does not carry a prison sentence - only a fine.

Netanyahu's defense attorney.

Adv. Amit Hadad,

It will further be argued that a significant portion of the gifts Netanyahu was unaware of, since his wife received them, not necessarily with his knowledge.

Therefore, it will be argued that Schwein should be deducted from the total amount claimed and not attributed to Netanyahu.

There may of course be additional defense claims.

A subject that was kept secret but "starred" in the 1,000 case, is Netanyahu's governmental actions for Milchen, at the same time as he is defined by him as his best friend.

Olmert has previously been convicted of breach of trust (in which Netanyahu is accused), because in one case he acted as a minister for a client of an attorney who was his former partner. It is more complicated because of his actions on his behalf, and defense attorneys will argue that Netanyahu's actions were justified and served the entire public.
