Can the Oktoberfest 2022 really take place?

In Munich, preparations are already in full swing.

Another decision has also been made.

Will the festival still wobble this year?

Munich Mayor Dieter Reiter (SPD) recently stuck to his decision, but left a back door open.

However, something else is certain now: The resale of reservations for the Oktoberfest remains prohibited according to a ruling by the Munich Higher Regional Court (OLG).

The operators of the "Ochsenbraterei" marquee had sued an event agency because they bought reservations from third parties and then offered them for much more money on an online site.

Once again, the operators were largely right.

In the tent itself, reservations cost a maximum of 400 euros for a table with 10 people - on the agency's online platform between 1990 and 3299 euros.

The first-instance judgment of the Munich I Regional Court was thus largely confirmed.

The internet offer was "misleading and therefore unfair", it said in the judgement.

"Through the offer, the defendant pretends to the customers that they are acquiring a legally enforceable right to be granted a table in the plaintiff's marquee, which is actually not the case."

However, unlike the previous instance, the Higher Regional Court judges did not see any right to compensation: "In the present case, there is no probability of damage necessary to determine an obligation to pay compensation." The court also denied a right to information.

According to the judgment of the "Ochsenbraterei", the event agency does not have to say who it bought the Oktoberfest reservations from.

According to the court, it is the first in a series of similar cases that has now been decided by the higher court.
