The Supreme Court today (Thursday) converted to kill the offense of murder in which the former head of Julis' council, Salman Amer, was convicted.

In doing so, he accepted the appeal of Amar's defense attorneys, Adv. Roi Belcher, Adv. Guy Zehavi and Adv. Ron Shrikki, and at the same time rejected the state's appeal for the twenty-year sentence handed down to him in the Haifa District Court about a year and a half ago. Supreme Court Justice Esther Hayut, Justice Yitzhak Amit and Justice Alex Stein even ordered that his sentence be commuted to 14 years in prison

Nabuani's family chose not to comment on the decision.

Judge Yitzhak Amit noted that the line of defense that Amar used in the hearing in the Haifa District Court was "unfounded and false," and that "it was not for nothing that he was 'thrown in the trash' and his memory was not mentioned in the appeal."

According to the same line of defense, Amer suffered a dissociative forgetfulness of a few seconds, which ended when the victim was lying on the floor.

Amer did change defense attorneys, and came to the Supreme Court when the main line of defense had changed, arguing that he should be convicted of manslaughter or manslaughter in circumstances of reduced liability.



Judge Stein, who wrote the verdict, noted that the danger of bodily harm to Amer from the assault in which the victim opened was "undoubtedly serious, but not excessive in severity", and that Amer, is not an ordinary person from the settlement, but has a security past, who served as head Council and was equipped with a gun so that one could expect from him a greater degree of self-control and restraint.

Despite this he "lost his temper, opened a brutal shooting, overcame the obstacle in the form of the divider, and killed the deceased."

For this reason he stated that "this act is therefore in a high degree of severity, which entails a severe punishment."

The offense was converted to manslaughter.

In an appeal filed last year, his defense attorneys sought to acquit Amer of all charges, stating that his actions that resulted in Nabuani's death were self-defense.

Alternatively, they sought to establish that Amer had not formed an intent to kill his ex-boyfriend, and therefore he should be acquitted of first-degree murder and convicted of manslaughter.

According to them, even if this interpretation is not accepted, the imprisonment of the former head of the council should be significantly shortened, "in a manner appropriate to both the customary ruling and the exceptional circumstances of the tragic event."



The incident in which Nabuani was shot occurred in September 2016, when he reached the parking lot of the Julis council building and threatened Amar, damaging his vehicle with a wooden stick.

In response, Amar fired several short-range shots at his upper body and head.
