Trial required against the former vice-president of the Council of State for complicity in moral harassment

In its final indictment, the prosecution requests that Bruno Lasserre be tried for complicity in moral harassment and his former subordinate, Fabien Zivy, for moral harassment, said the judicial source.


The Paris prosecutor's office has requested a trial against the former vice-president of the Council of State Bruno Lasserre in an investigation for moral harassment, when he chaired the Competition Authority, also involving his ex-right-hand man, learned AFP this Saturday from a judicial source.

In its final indictment, the prosecution requests that Bruno Lasserre be tried for complicity in moral harassment and his former subordinate, Fabien Zivy, for moral harassment, said the judicial source.

It is now up to the two investigating judges of the Paris court to order or not a correctional trial.

Lawyer Sophie Sarre, who defends Fabien Zivy with Me Sabrina Goldman, said she was “

nevertheless satisfied that the judicial institution is handling this file from a collective angle and not under the sole responsibility of Mr. Zivy

Bruno Lasserre, 68, chaired the Competition Authority (2004-2016) then the Council of State (2018-2022).

His lawyer declined to comment.

“Toxic and disqualifying”

Appointed in 2011 as head of the Authority's legal department, Fabien Zivy had seen his management qualified as "

", in particular towards an assistant, Alain Mouzon, in an audit rendered on April 15, 2013. Laid off eight days later by Bruno Lasserre, he remained in office for a month, before being transferred to the Authority.

He remained there until January 2014.

On March 27, 2014, Alain Mouzon, 46, was found dead in his apartment.

Two decrees published in April 2015 by the Ministers of Economy and Finance had concluded that his death was "

attributable to the service

" and constituted "

a disease of a professional nature

", according to

Mr. Mouzon was exposed to moral harassment which led to burnout and the development of severe anxiety disorders which led to his death

", confirmed the administrative court of Paris on March 17, 2016.

The State had been sentenced for gross negligence and to pay 60,000 euros to the agent's mother.

The latter had filed a complaint at the end of 2015 against Fabien Vizy and Bruno Lasserre, leading to the opening of a judicial investigation.

They were indicted in 2018 and 2019 respectively. In a letter sent to the staff of the Council of State when the prosecution was announced, the senior official had denied any involvement.
