Landowners Against Herzliya Municipality: "Inhibiting the Blue Coast Project" Israel today

2022-07-12T13:50:42.667Z

The landowners on whom the complex is to be built were surprised by the municipality's response that "the submission of the detailed plan is the responsibility of the landowners" • "This means that the municipality is giving up the project"

Has the Herzliya Municipality decided to "give up" on the prestigious flagship project of the Azure Beach complex?

So at least according to private landowners, who were surprised to find that the municipality is in no hurry, to say the least, to present detailed construction plans for the complex, which is expected to include 12,500 new apartments.

Real Estate Today learned that landowners contacted the municipality's planning department in April this year to find out about the progress of the complex planning procedures of the complex, but replied that "the responsibility for promoting detailed plans lies with the landowners - and that at this stage the municipality does not intend to initiate promotion. Of the detailed design. "

Following the municipality's response, the landowners, through Adv. Naama Schiff, a partner in Shuv & Co., wrote a letter to the architect addressed to Herzliya Mayor Moshe Fadlon, city architect and director of the planning department Monica Zer Zion and city engineer Hanna Hermesh. Were surprised to receive the answer that the municipality passes the detailed planning responsibility to the private owners, arguing that the private owners can not submit a detailed plan alone as it is a multi-owner complex, and a single owner or group of owners will not be able to undertake the plan without the local authority. A plan is expected to include balancing and division tables between owners, so it is true that the authority will take on the promotion in order to create a balanced plan.

Attorneys Shmuel Shuv and Naama Schiff noted that the meaning of the municipality's response is that the municipality is in fact giving up promoting the construction of the complex in the coming years, as the private owners cannot take on the detailed planning for the reasons stated.

"We represent a lot of private landowners in large complexes in Tel Aviv (Sde Dov plan, plan 3700), in Rishon Lezion (Alef complex) and other cities - and the authorities have always led the detailed plans. It is not clear how in reality "Of the rising apartment prices, the municipality is not working to promote the complex that can provide thousands more housing units for residents of the city and the area and help balance prices," the law firm noted.

The master plan for the Blue Coast complex located in the southwestern part of Herzliya was approved as early as January 2022 and stipulated that the complex could be built with 12.5 thousand apartments, 512 thousand square meters for employment, 134 thousand square meters for hotels and 69 thousand square meters for commerce. This is one of the most significant plans in Gush Dan that has been approved for about a decade. The land is held by hundreds of private landowners, by the Israel Land Authority and the Herzliya Municipality.

The "Real Estate Today" system has contacted the Herzliya Municipality for a response and it will be published when it is received.
