For ten years there has been disagreement in Seeshaupt about what should and can be built on the site of the former Demmel nursery.

Will there be a solution soon?

Seeshaupt - The so-called "Gärtnereiquartier" has been heating up tempers in the Seeshaupt community for years.

Property owner Katharina Heider is meeting with community representatives this Thursday.

Will there be an approximation?

Seeshaupter "Gärtnereiquartier": Living space for a maximum of 120 people?

"I became an architect because I want to do something," says Heider in her office on the site of the former Demmel nursery.

She has been the owner since 2007, the nursery was founded in 1902 by her great-grandparents.

The site with the number 442/1 is large: Heider calls more than 12,000 square meters her own.

Behind it is another property with the field number 470, which also belongs to the native Seeshaupterin.

Its size is over 3000 square meters.

A working model in her office shows how Heider imagines the “Gärtnereiquartier” in concrete terms.

On it are shown in miniature terraced, chain and semi-detached houses, there should also be an underground car park, a covered playground and a packing station.

The living space is intended for a maximum of 120 people.

Seeshaupter “Gärtnereiquartier”: In 2018, a decision was made to draw up a development plan

About ten years ago, Heider first started talks with the municipality regarding the land.

A lot has happened since then - the history of the "Gärtnereiquartier" is long and complex.

The decision to draw up a development plan for field number 442/1 was made by the municipal council in 2018, at that time still under the leadership of Seeshaupt’s ex-mayor Michael Bernwieser.

A decision had previously been made for the adjoining property.

Heider signs an urban development contract stipulating that she will make 810 square meters of the housing development (equivalent to about ten apartments) available for social housing, limited to a period of 25 years.

According to her a "maximum good deal for the community".

However, the project is not realized.

In 2020, the interpretation of the development plan will be canceled due to formal errors.

Seeshaupter “Gärtnereiquartier”: indoor area or indoor outdoor area or both?

In September 2021, some municipal councils will submit an application to reopen the planning for the "Gärtnereiquartier".

The municipal documents for the meeting state that a development plan should be created that “takes into account the planning law classification of the site as an internal outdoor area in accordance with § 35 BauGB”.

Former mayor Michael Bernwieser publicly claimed during his term of office that the entire area was purely indoors.

"It was always in the room that there is also a part of the interior outside area," says Heider.

If this had not been the case, she would have been allowed to build, according to her words, long ago.

"It wouldn't have needed an urban development contract," she says.

Indoors, indoors outdoors, or both?

In January of this year, Heider applied for a preliminary building permit for the north-western part of field number 442/1.

In her application she writes that she still wants to build living space "in order to meet the increasing demand for rental apartments for average earners in Seeshaupt".

Heider does not give a specific number of how much the square meter should cost.

“That would also be dubious,” she says when asked.

Seeshaupter "Gärtnereiquartier": The block on changes only goes through with the second vote

In March, the municipal councils unanimously decided to annul the 2018 resolution. They also decided to draw up a new development plan for the north-western part of field number 442/1.

At the same time, they initially do not impose a block on changes - neither for field number 442/1 nor for field number 470. Due to the repeal of the old decision from 2018, Heider terminates the urban development contract.

"That was obsolete," she says.

In the June meeting of the municipal council, the majority of the councilors present spoke out in favor of a ban on changes.

In the previous meeting, a building land model for Seeshaupt was also approved with just one dissenting vote.

Due to the ban on changes, Heider is currently unable to build – even if, according to the district office, there are already building permits on certain areas.

Your request for an exception to the ban on changes was rejected in the last municipal council.

The architect wanted to energetically modernize the residential building on the site where her office is located and increase and expand the warehouse opposite.

"Energetic refurbishment is wonderful," said councilor Dorothee von Jungsfeld at the most recent meeting.

"But I'm against any relaxation of the ban on changes." The majority of her colleagues agreed with the councilwoman.

Katharina Heider hopes for clarity from today's discussion with the community.

What does the community want?

Who is supposed to live in the Gärtnereiquartier?

Those are the questions that concern them.

She does not want to sell parts of the property to the municipality.

"I want to keep the design sovereignty - after all, I'm an architect," she says.

She doesn't care about the money.

She wants to build rental apartments.

"Otherwise I would have sold to an investor long ago."

The community says that they are still interested in joint planning with Heider and that the further procedure is to be discussed and marked out today.

The meeting will be attended by the members of the Gärtnereiquartier department (municipal councilors Maximilian Amon, Bendikt Fischer, Andreas Rilk, Dorothee von Jungsenfeld and Reinhard Weber), the second and third mayors (Bernd Habich and Armin Mell) and the head of the building authority (Sophia Meyer).

Two lawyers will also be present: Heider's and the municipality's lawyer.

Mayor Fritz Egold has been ill since this week.

However, he informed the local newspaper in advance that he would like a constructive exchange with Heider – and a relaxation of the situation.
