The bankruptcy application has been filed, the procedure is expected to open on October 1st.

If insolvency administrator Oliver Schartl has his way, the students at the Planegg-Krailling music school and their parents should hear as little as possible.

The students can continue to register, and school operations will begin on September 13th," says Oliver Schartl in the Merkur interview.

The district court in Munich has appointed the lawyer as the provisional insolvency administrator for the Planegg-Krailling music school.

The sponsoring association filed for bankruptcy in July due to impending insolvency.

Grants stopped

This step was preceded by months of disputes between the board and the music school works council.

The two municipalities of Planegg and Krailling, which are the main sponsors of the facility with their grants, tried to put the sponsoring association on a new footing.

Twice, in May and at the end of June, they failed at a general meeting in an attempt to push through a new statute.

As a result, the municipalities stopped paying out their grants and the music school ran out of funds for salaries by July.

"We made sure that the employees received their salary for July on time.

That will also be the case in August and September,” says Schartl.

Upon request, the Employment Agency pays compensation for the missing wages, the so-called insolvency money - but only in a period of three months before the opening of the proceedings.

Deadline October 1st

Schartl proposes October 1 as the date for this.

As a rule, the court follows the recommendation of the insolvency administrator.

Until the opening one is in a preliminary insolvency procedure.

Then there is a transfer of business.

The new sponsoring association, the foundation of which is currently being prepared, "acquires the business operations" of the current sponsoring association.

"We are selling the association's assets to the new owner," says Schartl.

The music school building on Pasinger Straße in Planegg is owned by the municipality of Planegg.

But not the musical instruments.

“You will be appraised by an expert.

That's not so little.” The income was used to cover the costs and satisfy the creditors.

The main creditor will be the Employment Agency.

The association will then be liquidated

Schartl: "This is a purely legal matter."

This week a circular was sent to the music students and their parents, coordinated with the school management.

Schartl: “The school year will start quite normally.

In fact, they shouldn't have noticed.

It is the declared goal of the communities that the school goes on.”

Planegg's Mayor Hermann Nafziger explained in the press conference that the music school teachers would be "taken over one to one" by the new sponsoring association.

And further to its statutes: "The main evil is then abolished that teachers and works councils can elect their own board."
