The hut in the Wiesseer Bergwald, which has been converted into a weekend cottage, is threatened with demolition.

Now those responsible for the project are speaking up for the first time: they feel that they are wrongly being pilloried.

– For the Miesbach district office, the matter is obvious.

Because a simple hut had been transformed into “a comparatively comfortable weekend cottage through extensive construction work” and this was accompanied by a loss of identity for the building, the protection of the hut was no longer valid.

The authority had therefore sent out a so-called disposal hearing to the owner in April.

A written statement from the client should now be followed by an oral conversation, according to the district office.

A final decision on the demolition will then be made "promptly".

Builder relies on official statements

In this phase, the father of the hut owner, Rudolf Schwaab, who was responsible for the conversions, and the lawyer Christian Pegau, as co-users of the hut above the Breitenbach valley, also spoke for the first time.

Not only do they consider the renovation measures to be process-free in accordance with the Bavarian building regulations, but they also refer to earlier statements by the authorities.

Accordingly, on January 11, 2021, employees of the Miesbach District Office made an inspection visit to the construction site of the "Winner Alm" - as the hut is officially called.

At that time, Schwaab and Pegau assure us, the winter garden, among other things, had already been renovated and the new cross member in the hut had also been installed.

All the renovation work found was checked on site at the time and found to be in order.

Why weren't you informed about possible complaints immediately after the visit to the district office and the construction site stopped? The two now ask themselves.

It was only from the press in March 2022 - a good year later - that we learned "that the hut was objected to by the authorities".

The two hut users also set their sights on the town hall in Bad Wiessee.

In September 2020, the local building authority was presented with the planned renovation measures.

Here, too, Schwaab and the carpenter commissioned received the information that the measures, apart from the new roof covering, all did not require approval.

Overall, Pegau and Schwaab, both based in the Tegernsee valley, cannot understand the excitement surrounding their hut.

This is by no means a new building, but rather the renovation of an existing hut from the 1940s or 1950s, the core of which has been preserved and has always been used for residential purposes.

"We want to have a nice time here with the family," says Pegau about the weekend cottage in the mountain forest.

A bedroom with six beds - there used to be a camp with supposedly eight beds -, a terrace with a view of the lake and a heated bath tub have provided the appropriate amenities since the renovation.

It is precisely this new quality of stay that is the crux of the matter for the district office.

When asked, a spokeswoman for the authorities admitted that the hut was inspected by the district office in January last year.

At the time, however, it was “unrecognizable” that a simple hut would result in a comfortable little house.

In fact, during the inspection at that time, individual construction measures that had already been carried out were identified, "which, however, were not subject to approval in some cases," says the spokeswoman for the district office.

In addition, parts of the property could not have been adequately assessed due to the snow situation at the time.

The district office makes it clear that it was not just the individual changes to the hut that were decisive for the opening of the building inspection procedure, but rather their entirety.

This is practically equivalent to a new construction of the building.

The head of the Wiesseer building authority, Anton Bammer, also admits that there was a brief discussion about the hut in his office.

Essentially, however, it was only about replacing the roof and pure renovation measures.
