Social and Labor Affairs issues the Industrial, Commercial and Agricultural Inspection Guide

The Ministry of Social Affairs and Labor issued the “industrial, commercial and agricultural” labor inspection manual related to regulating the friendly and balanced relationship between the production parties based on the provisions of Labor Law No. 17 of 2010, Law Regulating Agricultural Relations No. 56 of 2004 and Social Security Law No. 92 of 1959.

Director of the Labor Directorate in the Ministry, Mahmoud Damrani, said in a statement to SANA that what distinguishes the guide is that it will make the inspector fully aware of the provisions of Labor Law No. 17 and the Regulation of Agricultural Relations No. 56 of 2004, in addition to that it shortens a great deal of time in inspection courses and immediate engagement in the field of work.

Damrani pointed out that the tasks of the inspector, based on the evidence, are to take legal measures against employers who violate the provisions of Labor Law No. 17 and the decisions implementing its provisions, which are alerting, warning, legal control and proposing the closure of the licensed or unlicensed institution or facility.

Damrani pointed out that the guide gives the inspectors charged with monitoring the implementation of the provisions of the law and its executive decisions the status of judicial police and they are provided with cards proving their identity and their jobs, pointing out that they must provide technical information and legal advice to employers and workers on the best means to abide by the provisions of the law and to consolidate the concepts of cooperation and the existing relations between them.

Damrani explained that the labor inspectors must submit a detailed report according to the form approved by the ministry for each inspection visit they make to any facility or work site with their observations and recommendations regarding taking appropriate follow-up measures and preparing detailed monthly reports on the results of the inspection tours, in addition to a commitment to absolute confidentiality regarding the source of any complaint Submit to the relevant directorate or ministry about any violation of the legal provisions in force in the facility.

Damrani indicated that the guide includes that the inspector monitors the implementation of the provisions of laws and ministerial decisions and the protection of workers while they work according to the inspection forms and dictates the data contained therein that include data on the worker such as working hours, annual leaves, weekly rest, holidays, official occasions, overtime wages and special data with the employer.

Damrani added that the data of the employers that the inspector must register includes the training support fund for workers, the editing of workers’ employment contracts, granting his workers wages not less than the minimum wage, the internal system of the facility if the number of his employees exceeds 15, the women’s operating system, the provision of transportation, and the registration of workers with insurances. Social and periodic increase in wages.

According to Damrani, the inspector has the right to freely enter during working hours to all workplaces and inspect them, request the necessary papers, documents and data from employers, ask the employer to post information in the workplace, take samples of materials used or circulated for analysis purposes, and suggest taking immediate measures when there is an imminent danger to Workers threaten their health and safety.
