According to the Federal Court of Justice (BGH), the asylum seeker from Ghana who was killed in an arson attack in Saarland in 1991 had little chance of surviving.

According to a decision by the Karlsruhe court published on Wednesday, the 21 people in the accommodation in Saarlouis were severely restricted in their ability to counteract the fire that was set around 3.30 a.m., with which the further custody of the alleged perpetrator was confirmed.

Karlsruhe/Koblenz - "The fire spread to the entire stairwell at great speed, with the spread being favored by the 'chimney effect' of the stairwell," the BGH said on 13 July.

"The resulting barrage of fire hit the Ghanaian national Y in the attic hallway." Burns and smoke inhalation led to multiple organ failure.

The 27-year-old died the same day, on September 19, 1991. Two other residents were injured when they jumped out of the window.

The accused denied having started the fire, the judges said.

But there is an urgent suspicion.

At a barbecue, the suspect said to a witness in reference to the arson attack in 2007: "It was me and they never caught me".

In the right-wing extremist scene, to which the accused belonged, "xenophobic arson attacks were regularly discussed and advocated".

The accused had made himself punishable "with a high probability of murder" and attempted murder and arson resulting in death.

According to the federal prosecutor, the German suspect has been in custody since April of this year.

The Karlsruhe prosecution took over the investigation in April 2020 based on new findings after the investigations by the Saarland state judiciary had been discontinued.

The Saar police apologized for "deficits in the police work at the time".

The state protection senate of the Koblenz Higher Regional Court must now decide whether a trial will be scheduled on the basis of the indictment.

The responsibility of the Koblenz state protection senate results from a state treaty with the Saarland.
