Donald Trump left the White House less than two years ago, and is already considering whether to run for president again in 2024.

However, as the former president debates the perfect timing to announce his candidacy, a slew of investigations and civil lawsuits are underway against him — some of which could lead to criminal charges.

So far, Trump has not been charged with any crime, and it is unclear if he will.

He denies all the accusations against him and calls the investigations a "witch hunt".

Trump is currently facing an FBI investigation focused on how the former president handled classified official documents while in office — the reason his Florida estate was searched last week.

Moreover, two other criminal investigations against Trump are still ongoing: one regarding election interference in the state of Georgia and the other regarding possible financial offenses.

At the same time, as part of a federal investigation, the possibility of recommending criminal charges against Trump regarding his central role in encouraging the assault on Capitol Hill on January 6, 2021 is being considered.

Regarding the investigation, which focuses on whether he incited the violence on Capitol Hill, possible charges include interfering with the counting of votes in Congress and conspiring to defraud the United States by changing the official results of the 2020 election.

The penalty: fines or imprisonment.

A lawsuit by Trump would be unprecedented because to date, no former president has been sued by the state.

Trump is also expected to stand trial in a civil lawsuit in Manhattan federal court in February 2023 on charges that he defamed journalist E.

Jean Carroll, regarding her claim that the former president raped her in the 1990s.

In a 2019 article, Carroll wrote that Trump assaulted her in a dressing room at the Bergdorf Goodman chain.

Trump, then a sitting president, denied the allegations.

In general, legal experts believe that all these troubles will not add up to a ban on running in the next election - even if Trump is convicted of violating the Criminal Code 18 USC in connection with the classified documents, it is unlikely that it will prevent him from running in the next presidential election in the United States or lead to the filing of an indictment.

According to Bradley Moss, a lawyer who specializes in national security, he told CNBC that Reality Wiener, a former contractor for the National Security Agency, leaked classified information in 2017 about Russian interference in the 2016 election.

"She received a five-year prison sentence for leaking one document in violation of Code 18 Section 793, which also appeared in the search warrant for Trump's Florida estate. Weiner pleaded guilty in 2018 and was granted early release in 2021 for good behavior.

John Coffey, a law professor at Columbia University, believes that federal authorities will not sue Trump over the classified documents if they get back everything they sought.

But it is highly likely that he will be sued regarding involvement in the storming of Capitol Hill.

"The offenses concerning the documents are more technical and are not 'engraved on the tablets of the covenant that Moshe took down from the mountain'. On the other hand, the case of January 6 could yield accusations of coup, treason or incitement - older and much more serious offences," he said.

Charles Elson, a lawyer who specializes in corporate law, told CNBC that he, too, is not convinced that the FBI can actually prosecute and convict Trump regarding the items that appeared in the search warrant for his home.

"In this case, it makes sense to file a lawsuit only in the event that someone sold classified information for financial gain. It seems that there is an attempt here to find a criminal offense in the conduct of the former president, instead of looking for a crime that was actually committed. This is an extremely dangerous precedent in our democracy," he added.

Who is the leaker?

Randy Zelin, a lawyer who specializes in legal disputes, said the real difficulty for authorities regarding the violation of classified documents clauses will be to prove intent.

"Proof of some kind of communication will be required; an email, message or conversation. In that case, the authorities will have to rely on people close to Trump to cooperate with them."

Indeed, Trump allies believe that an adviser or advisers to the former president may have provided information to the FBI about the documents the former president kept at his Florida home.

According to a report by the "Wall Street Journal", investigators received a tip about the possibility that there were additional classified documents in the house.

"A person familiar with the matter told investigators that there are additional documents at the private club" besides the documents Trump returned to the National Archives earlier this year.

According to "Newsweek" reporter William Arkin, this is "an official with direct information about the documents and the FBI's deliberations on how to act on it."

According to him, "the search at Mar a Lago was based primarily on information from a confidential FBI human source - a source that could have identified the specific classified documents that Trump still had hidden in his home and their exact location in the home."

Trump's former personal lawyer, Michael Cohen, believes that the leaker must be someone from the former president's inner circle.

He told "Insider" that he would not be surprised if it turns out that the leaker is Jared Kushner (Ivanka Trump's husband) or one of Trump's children...who else could know about the existence of the safe and the documents that were in it?" he said.

To Jared and Ivanka There was a top-secret security clearance at the time when advisers to the former president served in the White House and were very close to his affairs. However, the couple has already distanced themselves from Trump since he left office. Ivanka said she did not believe her father's "big lie" theory about stealing the election from him and told the committee The special committee of the House of Representatives that is investigating the events of January 6, because she does not believe her father's false claims. It was recently reported in the American media that she is trying to prevent Trump from running again in 2024. The question is whether Trump's daughter and son-in-law are able to sacrifice him to protect themselves?
