Karlsruhe - The Federal Constitutional Court published its decision on several constitutional complaints against the measles vaccination requirement on Thursday.

This was announced by the highest German court in Karlsruhe on Monday on its website.

The obligation to vaccinate is intended to help prevent outbreaks of the highly contagious viral disease as far as possible.

Since March 1, 2020, parents who want to send their child to daycare or to a childminder or want to start school must prove that it has been vaccinated or has already had the measles before admission.

After a transition period of more than two years, this obligation to provide proof has also applied to all children who have already been in the facilities since August.

Without proof, care can be refused.

Compulsory schooling comes first.

However, fines of up to 2500 euros are threatened.

Nobody in Germany is compulsorily vaccinated.

The plaintiffs see the obligation to vaccinate as a disproportionate encroachment on the children's fundamental right to physical integrity and their right of upbringing as parents.

In May 2020, the constitutional judges rated the interests of the general public higher in the summary proceedings and initially gave the green light: It is about “defending against infection-related risks to the life and limb of a large number of people”.

However, a detailed examination only takes place in the main proceedings.

Experts warn that measles is not a harmless disease.

Serious complications can occur, especially in the youngest, pregnant women and adults with an immune deficiency, which sometimes result in permanent damage or even death.

The obligation to vaccinate also applies to other community facilities where many people come together, such as refugee accommodation.

Employees such as teachers and educators are also included.
