A. had a background of psychiatric disorders and alcohol addiction.

In 2020 he was 61 years old, married with two children and a grandson, who was related to him and loved him very much.

One day he stood on the balcony of his house and started shouting illogical sentences loudly and threatened to commit suicide.

The frightened neighbors immediately called an ambulance and the police, who evacuated A to Asuta Hospital in Ashdod.

At the hospital, A continued to be restless and threaten suicide.

Among other things, he said that he was seeing all kinds of visions and it was suspected that he was under the influence of alcohol.

In the emergency department of Assuta Hospital in Ashdod, they knew about the background of his psychiatric disorders and that he was diagnosed as suffering from anxiety and depression, but at Hospital A he was not examined by a psychiatrist.

The medical team contacted the lead psychiatrist by phone, and he announced that he did not intend to come to examine A.

He also said that it was heard that it was alcohol poisoning and therefore there is no need for psychiatric intervention, and if A does not wish to be hospitalized, they should release him, without any examination.

A, who was left unattended, fled the scene alone while barefoot, got into a taxi and returned to his home.

When he reached his home, where his wife and son were, he turned to rest for a short time.

Later in the day, when his son went downstairs with the dog, he ran to the balcony of the house, got stuck in the shutter rails, fell and opened his head.

His frightened wife wanted to help him, and he sent her to bring him handkerchiefs to soak up the blood that was pouring from his head.

As soon as his wife turned to get the absorbent paper, A got up and jumped from the balcony of his apartment on the fifth floor.

He was found unconscious with multi-system damage.

He was pronounced dead at the hospital.

Recently, a claim was submitted to the Jerusalem Magistrate's Court against Assuta Hospital in Ashdod by the law firm of Hazot Bar Zabintsky.

Attorney Limor Bar Peretz from the firm that deals with torts, clarifies that this is a case of clear negligence.

"From a legal point of view, the duty of care belongs to the hospital, the medical institution is the one that has to take responsibility for the patient. From the moment the medical institution undertakes to treat the patient, it is obliged by law to use the necessary care and skill within the framework of the doctor-patient relationship. In this case, the hospital Neglected his duty."

The opinion of the psychiatrist on behalf of the prosecution states that when the team contacted the psychiatrist, he had to go immediately to the emergency room in order to have him undergo a psychiatric examination.

Negligence is exacerbated in light of the fact that there is a case of a large number of risk factors for suicide: this is a person who was under a psychotic attack, restlessness, loss of reality check, a gender risk factor, known to suffer from excessive alcohol consumption, threatening to commit suicide - after all this he was released without being tested for by a psychiatrist.

"The time for the end of the psychiatric drive's shift was approaching and he refused to come. The fact that he did not recommend supervision in the emergency room until the patient was present is striking, and if the patient had already escaped, where were the attempts of the staff to protect him? They did not even bother to inform the family or the police that he escaped from the emergency room," says O "D. Bar Peretz

"It is clear to everyone that he should have been hospitalized for observation, and in the report there was no record at all that he refused to be hospitalized.

If the patient had been placed under supervision until the arrival of the psychiatric therapist, most likely his death would have been prevented, and his life would not have been prematurely cut short."
