A Texas teacher convicted of having sex with a 13-year-old student in her class for three years won't have to report to prison until next year — because she's only a child.

ABC reported that 31-year-old teacher Marka Bodin was sentenced last Tuesday to 60 days in prison and 10 years of probation, but she won't have to report to the Harris County, East Texas jail until June 2023 - because she just recently gave birth.



The student, now 16, said at trial that Bodin, who was his English teacher, befriended him by playing Fortnite and then began sending him provocative text messages and 25 to 40 nude photos of herself between April 2020 and February 2021.



The abusive sexual relationship lasted more than two years, When Bodine went to a student's home two to four times a month until March 2021, their relationship ended after the student went to the police and "begged for help."

It was reported in the local media that the baby she recently gave birth to is not the result of Bodin's long-term relationship with the student.

Bodine's charge, persistent sexual abuse of a minor under the age of 14, normally carries a maximum sentence of life in prison.

Prosecutors in the trial asked for a sentence of at least 20 years behind bars.

Christopher Downey, a criminal defense attorney, told abc13 that a possible factor in Bodin's light sentence could be evidence of her state of mind at the time of the abuse.

"I think that a significant part of the explanation for this decision may lie in any mental information that the defense provided to the court," Downey said, but noted that it is likely that social factors had a hand in Bodin's fate, "By all accounts, this is an unusual result. I am sure that the gender of the person standing For the trial, the fact that it was a woman who was accused of having sex with a young boy also affects that," Downey said.



The abused boy left the courtroom in the middle of the sentencing because he was "very angry at the outcome," said lawyer Jana Oswald.

Ms. Oswald added: "My heart aches for the complainant and his family. I'm really disappointed in the outcome as a plaintiff and I'm disappointed as a citizen of Harris County," she told NBC Houston.



Bodine's defense attorney said: "No case is like another and not every case deserves to end up in prison. We believe the judge followed the law and imposed an appropriate sentence," attorney Dustan Nyland wrote in a statement to the KPRC 2 news network, noting that in addition to the prison sentence, Bodine must register as a sex offender and pass Mental therapy.

The investigation into Bodine began in April after the former student appeared at the police station with allegations of ongoing sexual abuse.

"It was definitely a cry for help," said police chief Jeff Brett, "he contacted the school as well as the police."

The boy told authorities that Bodin moved into his apartment complex after her divorce - and that the two had sex in her classroom and in her car on numerous occasions, according to his affidavit.



Jennifer Kratky, whose daughter was taught by Bodin, told NBC: "It's really impossible to even think about why anyone would do something like this, but evil exists in the world. It's even more upsetting now to find out that she got this ridiculously light sentence." .

Court documents show that Bodin contacted the police claiming that a former student in the 6th grade was harassing her and threatening to harm himself.

Bodin later admitted to having a sexual relationship with the same boy, starting in 2018 when he was just 13 years old, sending him dozens of videos and nude photos of herself.

Chief Brett said the investigation turned up evidence of social media posts and text messages, indicating Bodine encouraged her victim to have sex with her.



The Tomball Independent School District where she taught the boy released a statement stressing that the case involved a former student "who is not currently attending Tomball ISD schools."

According to district officials, as soon as they learned of the allegations against Bodine, she was placed on administrative leave and has since resigned.

Her LinkedIn profile indicates that Boudin taught middle school English for nearly six years.
