Manfred Genditzki was in prison for around 14 years.

He is said to have murdered a woman in Rottach-Egern in 2008.

There were long doubts about that, now he is free again.

Munich/Rottach-Egern – Is he the victim of a miscarriage of justice?

Manfred Genditzki had to sit in prison for almost 14 years because he is said to have murdered an 87-year-old in Rottach-Egern in 2008.

There have been massive doubts about this for a long time, experts consider a fatal fall to be probable.

On Friday, August 12, the Munich II Regional Court ordered a retrial.

The 62-year-old was released immediately.

We spoke to his attorney, Regina Rick, 53, who has been campaigning for his release for nearly a decade.

How is Mr. Genditzki after the surprising release?

I don't think he can get it right.

He has to process that first, all the stolen years.

How did the dismissal go?

The decision was effective immediately, the JVA received a fax and carried out a quick release.

Mr. Genditzki worked in the laundry, where he got a call from the administration.

It took a while for him to sign everything and get his belongings back.

Then he was finally free.

Yes.

He came out with a trolley case and two bags.

Among his belongings was an ancient LG mobile phone, which we both looked at a little at a loss.

There is no such thing anymore.

He was worried about how the laundry would manage without him.

It has to be said that he was treated well in prison, perhaps because everyone assumed he was innocent.

How was the reunion with his family?

The woman was there and hugged him and then me.

She hasn't let go of me.

That really moved me, you don't experience something like that every day.

Then I left the family alone.

How was the contact with the family in prison?

He has a grown-up daughter from his first marriage and is already a grandfather twice.

His two children from the current marriage are 17 and 13 – he hardly saw the younger one grow up.

But he was in regular contact.

The Corona period was difficult because they could only meet with a partition.

Does the family get psychological help?

If they need help, we would organize that.

But I don't think that's necessary.

Mr. Genditzki is tough after all this time.

Did you and he expect the turnaround on Friday?

no

After hearing the eight experts, I was certain: There can be no other result.

But then came the statement from the public prosecutor's office, which surprisingly once again spoke out against the reopening.

She maintained that the lady had no reason to soak laundry in the tub.

A witness had testified otherwise.

Yes.

Years ago, a witness called me.

She said that Ms K. had previously soaked laundry in the tub, that was a real quirk.

And she fell more often.

The statement was considered irrelevant by the prosecutor.

What else went wrong in this process?

Pretty much.

It all started with the fact that the police at the location where the elderly woman was found did not behave as they should.

The body was left in the water for three hours and the temperature of the room, the water, and the body were not measured.

It was therefore very difficult to determine the time of death afterwards.

And then there was the scandal with the report.

Bathtub murder: "Incredible that you just made up a story"

Can you explain that?

The medical examiner initially wrote in the autopsy report that the woman probably fell into the bathtub.

When the police told him that Mr. Genditzki was a suspect, he changed his opinion.

Suddenly the scalp hematomas, which he initially thought completely meaningless, were an expression of blunt force.

And he made it a point not to stay lying in the tub after a fall.

Experts have disproved that.

The accusation that Genditzki stole money from the woman was also wrong.

Yes.

The prosecutor broke away the motive.

It's unbelievable that you just invented a new story.

A judicial scandal.

There is no evidence, no circumstantial evidence, nothing for the argument that was then supposed to serve as a motive.

And the time of death, which we determined more precisely with a thermodynamic report, also shows that it cannot have anything to do with it.

The lack of wash skin and the ability to push away the corpse stains also resulted in a much later time of death.

It is also striking that right after the first verdict I applied for access to the files – the evidence objects should have included the woman’s watch, which would have shown the time of death.

I haven't heard anything for a long time.

When I asked, they said the evidence was destroyed.

Is your client afraid of being convicted again?

He is suspicious when it comes to the judiciary.

I'm always careful.

There will now be a third main hearing with the taking of evidence from the beginning.

I'm looking forward to questioning the investigators from back then.
