President Bashar al-Assad issued Legislative Decree No. (13) of 2022, which carries a wide range of facilities and exemptions that provide a supportive environment for owners of economic activities in all its forms inside the old city in the governorates of Aleppo, Homs and Deir ez-Zor, including the old and heritage markets.

These unprecedented facilities include facilities, workshops, and shops, in addition to residential homes located within the administrative boundaries of the old cities in the three governorates.

The decree exempted establishments, taxpayers and owners of economic activities from all taxes and financial and local fees that include restoration and rehabilitation works, whether for establishments, shops or homes until the end of the year 2023. In addition to exemption from income tax on all financial dues received by workers in these establishments until the end of 2027.

The decree closed all financial claims, fees, service allowances and complements incurred by establishments, taxpayers and owners of economic activities within the old city before the date this law came into force. Real estate and properties until the end of 2027.

The decree also canceled subscription fees, consumption values, benefits and fines, whether in the areas of telecommunications, electricity, water and sanitation, while the exemptions made by this decree did not include taxes resulting from real estate sales and rents subject to Law No. 15 of 2021.

These exemptions and facilities support the return of production, work, industry and commercial movement in the old and heritage markets, and grant the initiators of returning and operating their shops financial privileges to speed up their return in preparation for the return of economic life to the old cities.

Below is the text of the decree:

Legislative Decree No. (13)

President of the Republic

According to the provisions of the Constitution.

Draw the following:

Article 1 - Establishments, taxpayers and owners of economic operators shall be exempted from all taxes, financial and local fees, service fees, additions and complements imposed on restoration and rehabilitation works for their facilities, shops and homes located within the administrative boundaries of the old city (old and heritage markets) in each of the governorates of Aleppo, Homs and Deir ez-Zor, until 12/31-2023.

Article 2 - Establishments, taxpayers and owners of economic activities referred to in Article (1) of this Legislative Decree, until 12/31/2027, shall be exempted from the following costs and burdens and their complements and additions of any kind:

a.

Income tax on net profits resulting from the exercise of industrial, commercial and non-commercial professions and trades (the category of real profits taxpayers, the category of lump-sum income taxpayers).

B.

Income tax on salaries, wages, returns, compensation, prizes, bonuses and all other monetary or in-kind benefits for its employees.

c.

Real estate and estate income tax.

Dr.

Stamp fee for transactions related to the practice of industrial, commercial and non-commercial professions and crafts.

Article 3 - The exemption referred to in Article (2) of this Legislative Decree does not include the assignment of tax on real estate sales and rents subject to Law No. (15) of 2021.

Article 4 - Establishments, taxpayers, and owners of economic activities benefiting from the provisions of Article (2) of this Legislative Decree shall be determined by a decision of the Director of Finance in the competent governorate and approved by the Director General of the General Authority for Taxes and Fees.

Article 5- All verifications of taxes, fees, service charges, additions and complements resulting from establishments, taxpayers and owners of economic operators benefiting from the provisions of Article (2) of this Legislative Decree shall be closed before the date of its entry into force.

Article 6 - All real estate taxes and rents for real estate located within the administrative boundaries of the Old City in each of the governorates of Aleppo, Homs and Deir Ezzor are folded, until 12/31/2022.

Article 7 - The subscription fees, consumption values, interest, fines, additions and supplements due to the Syrian Telecommunications Company, the General Electricity Company, and the General Corporation for Drinking Water and Sanitation in each of the governorates of Aleppo, Homs and Deir ez-Zor incurred by establishments, taxpayers and owners of economic activities benefiting from the provisions of Article (2) of This Legislative Decree before its effective date.

Article 8 - Amounts paid before the entry into force of this Legislative Decree shall not be refunded.

Article 9 - The Minister of Finance issues the executive instructions for this legislative decree in coordination with the concerned ministers.

Article 10 - This Legislative Decree shall be published in the Official Gazette.
