Following two plead guilty earlier and sentenced to prison, today (18th) another defendant who pleaded guilty was sentenced in the Kowloon City Court.
Acting Chief Magistrate Huang Yayin pointed out that the 30-year-old female defendant involved in the beating of the two children attributed the crime to the work culture and impulsiveness of the organization, which was a performance without frankness in facing the guilt.
Huang Guan said that he did not comment on the culture. It was also the defendant who gave up his professional ethics and committed extreme wrongdoing. He was sentenced to 4 months and 10 weeks in prison.
Defendant Zhang Huiyan (30) pleaded guilty to two counts of child abuse.
According to the case, on November 29, 2020, after witnessing the boy K dropping the quilt on the ground in the crib, Zhang hit K on the head with his right hand, and K immediately fell on the bed.
After K stood up again, Zhang, who picked up the quilt, slapped K in the face vigorously, causing K to fall down again; on December 5, when Zhang was cleaning the room, the boy AH put the toy in his hand on his head, Zhang Tuxing snatched the toy and pushed AH's head. AH's head hit the bed, and Zhang then hit AH's face twice with his hands.
The official reprimanded the defendant for showing no mercy
Huang Guan sentenced him to say that in the first child abuse incident, the defendant hit K on the head, causing him to fall directly from the crib, and K then stood up again.
The defendant stopped him in a rude way, hitting K with the palm of his left hand, and the force was so violent that the crib vibrated.
Afterwards, the defendant left without any consolation or concern, and left without any sympathy. It was not all for work needs, but only to punish K with violence.
Huang Guan believes that it is normal for young children to explore the world with their limbs and to drop the quilt to the ground. He does not understand the disciplinary function of corporal punishment.
If the defendant does not tolerate it, his personal character and level of professional integrity are not suitable for working with children.
As for the second child abuse incident, Huang Guan approved the defendant to pay more attention to toys than to AH. His excessive behavior was because AH lifted the toy up, but AH was able to get the toy in the crib, which must be allowed by adults. , and there are other children beside them who have the same behavior.
And if AH is to be beaten just for doing so, there are doubts about whether the defendant really cares about children.
In addition, the defendant should know that when AH falls in the narrow crib, he will inevitably hit the fence, so the defendant obviously ignores the danger, does not care about the welfare of AH, and just wants to punish AH.
Even if there is no evidence that AH was injured, he must feel pain, and there are other children at the scene who are concerned about the incident, but the defendant does not care to be seen, which is also a serious part of the case.
Huang Guan continued to point out that the defendant attacked the two young victims more than once, although the duration was short, and the incident occurred in a cramped crib. The boy had no way to escape, and he did not know the reason for the attack.
The defendant blamed the crime on the organization's work culture and impulsiveness. Although the judge did not comment on the work culture of the organization involved, the defendant had only been employed for a few months at the time, and had not yet passed the probationary period. He even signed the work code and should not be affected by the work culture.
Huang Guan therefore believes that this is the defendant's performance of not frankly facing the guilt, abandoning his professional ethics, and committing extreme wrongdoing, and finally sentenced him to 4 months and 10 weeks in prison.
