Relationship dispute escalated: 49-year-old hit his partner's son in the face – now the court judges

A 49-year-old from Weilheim punched his partner's son in the face.

Now he has been convicted in the district court.

Actually, he just wanted to settle a dispute, he said.

But then a 49-year-old from Weilheim punched his partner's son in the face.

He is said to have choked his partner beforehand.

The case has now been heard before the District Court of Weilheim.

Weilheim – On an evening in February this year, the woman went out with her 20-year-old son.

She had previously had an argument with her new partner.

The 49-year-old also came to the bar in Weilheim to "put an end to the dispute".

Finally, a holiday together was imminent.

He found his partner outside smoking, wanted to talk to her and put his arm around her shoulders.

She then yelled at him not wanting to talk to him.

The 44-year-old's son probably perceived the situation as threatening and intervened.

For him it looked as if his mother had gasped: "I can't forget that," he said.

He then approached the man and wanted to tear him away from his mother.

The 49-year-old man, who had already attracted attention several times, turned around and hit the 20-year-old in the left face.

The latter fell to the ground from the force of the blow.

When asked by the presiding judge, Stefanie Rainer, the accused admitted that it may have looked as if he had his partner "in a headlock".

He claimed it was "not a targeted action".

He felt attacked and hit his fist when he turned around.

He insisted that he would never have struck if he had known the victim was his partner's son.

The very next day he apologized to the 20-year-old via a WhatsApp voice message: "I'm really sorry." A personal discussion was still pending at the time of the meeting.

According to their own statements, both the mother and the son were drunk, but still able to walk straight: "drunk, not drunk".

The accused himself was sober.

Unlike her son, the 44-year-old firmly claims that she was not choked.

However, she also does not remember exactly what else she said in her drunkenness after the two had continued their evening in the bar.

The son, who had been in pain since the incident, only realized the extent of the blow when he was diagnosed with a mandibular fracture several days later.

As a result, he was no longer able to eat properly.

The situation also took a toll on him mentally.

He claimed that his mother had told him before the evening that there had already been violent attacks in the new relationship.

Mother and perpetrator went on vacation as planned and want to get married

Irrespective of the court hearing, the 20-year-old received a transfer of 2,000 euros as compensation for pain and suffering from his mother – half of which was paid by her new partner.

The woman still has a good relationship with the latter.

The two went on vacation as planned and also intend to get married.

Contrary to the defense attorney's opinion, both the public prosecutor's office and judge Rainer were not convinced that the 49-year-old accused's blow was self-defense and agreed with his partner's son.

According to the statements of the forensic medical expert, Matthias Eppler, the present case is an intentional but not dangerous physical injury, since the blow was not life-threatening in the abstract.

Nevertheless, the injured person had to contend with considerable limitations as a result of the fact and still feel the after-effects a little.

Accused sentenced to ten months probation and 1500 euros probation condition

The long list of past crimes also flows into the verdict.

On the other hand, the defendant benefits from the fact that he paid part of the compensation to the victim and apologized twice – first on the day after the crime and once more formally in court.

The verdict of the district court is: ten months imprisonment on probation.

The accused also has to pay a probation condition of 1,500 euros to the injured party for damage compensation.

The verdict is not yet legally binding.

When asked, the court said that the 49-year-old had already appealed.
