A passionate hunter was denied an extension of his hunting license because of a rather rare weapon transport.

It was a stressful day on October 10 two years ago at a construction site in Schierling.

A house in Schierling was to be demolished.

The road had been closed because there was a risk that parts could end up there.

And then, just under an hour before the lockdown expired and time was running out, an arsenal of five rifles, two pistols and lots of ammunition fell from a false ceiling that an excavator had just torn down.

46-year-old Stefan K. (name changed) quickly followed his boss's instructions.

Because people were already gathering around the guns and that would have led to further delays, he was supposed to pack the guns in the car and take them to the nearest police station.

Stefan K. is a hunter himself.

He has a hunting license and is the owner of several gun ownership licenses.

He runs a hunting school in the Regensburg district, and for a short time he also tried selling game with a shop in Regensburg.

He unloaded the rifles, wrapped them in cloth, packed everything together with the ammunition in a caddy and drove everything together with a colleague to the police station in Neutraubling.

He didn't think twice about it, he said on Tuesday before the Regensburg Administrative Court.

This is where the 46-year-old is fighting for his hunting license.

After weapons transport to the police: criminal complaint, hunting license gone

When he handed over the weapons, the case was actually over for him, reports K. But the officers then asked him to go to the police station again.

He will now be reported for illegal weapons transport.

The problem that the passionate hunter had not considered: if a gun is transported in a vehicle, it must be ensured that it is not ready for use or accessible in the vehicle - it must therefore be housed in a lockable case or gun case, which Stefan K .

The weapons, albeit wrapped in cloth, lay ready to hand in the rear of the Caddy.

The pistols were loaded.

Contrary to legal regulations, the remaining ammunition was in the immediate vicinity.

While the criminal complaint was dropped a few weeks due to minor guilt, the Regensburg district office refused to extend the 46-year-old's hunting license, revoked all weapons permits and asked him to hand over his weapons.

Because of a gross violation of the Weapons Act, he lacked the necessary reliability to carry a weapon, was the main justification.

Hunter sues for hunting license: administrative court sees “atypical case”

In view of the situation on the construction site, but also the prudence that he had shown despite everything, Stefan K. sees it as an “atypical case”.

In the situation with the expiring roadblock, people who were already standing around with their guns and his boss's instructions, it was hardly reasonable to call the police to pick up the guns.

"That would have taken far too long.

We wouldn't have finished there," confirms a colleague on the witness stand.

The 4th Chamber at the Regensburg Administrative Court saw the case in a milder light.

The decision to revoke the weapons license was lifted.

The district office must now decide again on the extension of K's hunting license in view of the verdict.
