Defendant Fang Jiale, 20 years old.
He denies 1 count of rape and 1 count of unlawful sexual intercourse with a girl under the age of 13 of alternate charges, alleging that he raped X on the stairs of a building in Tai Wai on October 19, 2020.
The alternate charge alleges that the defendant had unlawful sexual intercourse with 12-year-old girl X at the same place and on the same day.
The defendant Fang Jiale denied rape and unlawful sexual intercourse with a girl under the age of 13. The case was tried in the High Court.

Defendant and girl X live in the same building but do not know each other

The prosecution and the defense agreed on the facts of the case that the defendant had earlier pleaded guilty to indecent assault, alleging that he inserted his fingers into X's vagina, and reached into X's clothes to touch his chest on the date and place of the crime.
