Senate proposes blood alcohol limit for hunting

A senatorial mission, launched last November, proposes this track to limit accidents and attracts criticism from supporters of hunting.

This is the twelfth recommendation of the report on securing hunting presented Wednesday, September 14 by the Senate.

It is already causing strong reactions among supporters of the hunt.

It all started with a petition, signed by 120,000 people, who requested changes to the texts in force to regulate hunting, following the accidental death of a 25-year-old man, killed by a hunter in December 2020 while he was chopping wood.

Subsequently, the senators took up the issue, giving birth to thirty proposals.

The twelfth specifically proposes to "

prohibit alcohol and the use of narcotics during hunting

" and to "

align the blood alcohol level retained, the prohibition of narcotics as well as their respective sanctions with the rules in force in matters of the Highway Code

”.

Today there is no limit to alcohol consumption during hunting, but drunkenness is already considered by the courts as an aggravating circumstance in the event of an accident.

If this legislative amendment were to be applied, hunters, when practicing their activity, should have a blood alcohol level not exceeding 0.5 grams per liter of blood and be negative for narcotics.

In the event of non-compliance with these prerogatives, the sanctions envisaged by the report are: the seizure of weapons, the suspension of the hunting license for 3 years and a fine of 135 euros.

To ensure compliance with these rules, agents from the French Biodiversity Office would be responsible for controlling hunters and warning the police and gendarmes.

The senatorial mission itself showed that alcohol was only linked to 9% of hunting accidents, which is much less than for road accidents.

According to Charles-Henri Bachelier, there would have been five accidents related to a state of intoxication in 2021.

Alcohol prohibited while hunting abroad

In Germany, alcohol during the hunt is strongly discouraged by the federal authorities, but not officially prohibited.

On the other hand, according to case law, the consumption of alcohol before or during hunting, even at a low level, justifies the suspension or withdrawal of the hunting licence.

If the German hunter tests positive for alcohol, he is not considered reliable enough to hold a firearm.

Across the Channel, the handling of a firearm while being alcoholic has been prohibited since 1876. Spanish law is the one that comes closest to the proposal of the French report.

On the other side of the Pyrenees, the road alcohol level has been used for hunting as a threshold by royal decree since 1993.

The report makes other proposals to regulate hunting, including the request to introduce an offense of obstructing hunting in the Penal Code, the obligation to pass a certificate and that of providing an annual medical certificate ( which is already required once to pass the hunting license).

On the other hand, the idea of ​​a day without hunting carried by EELV was not retained.
