Gérald Darmanin wants a refusal of an asylum application to be worth a deportation measure

2022-09-20T17:57:14.961Z

During a parliamentary hearing, the Minister of the Interior justified this desire by the “delusional” paths of asylum seekers, who can use “up to twelve procedures” for appeal.

The refusal of an asylum application at first instance must be synonymous with automatic expulsion, proposed Tuesday, September 20 during a parliamentary hearing the Minister of the Interior, Gérald Darmanin, who will introduce a new law in the coming months on asylum and immigration.

Upstream of this bill which must be tabled in January and which will be the subject of a parliamentary debate at the end of 2022, "

we proposed to the Council of State (...) that when there is a refusal request for asylum, there is concomitantly an OQTF (Obligation to leave French territory) which is issued, or in any case a refusal of a residence permit and a pronounced expulsion

", declared Gérald Darmanin before the commission of the laws of The national assembly.

Concretely, the Minister of the Interior wants to change the law so that a negative decision by the Ofpra (French Office for the Protection of Refugees and Stateless Persons) is worth a decision of expulsion without even waiting for a possible appeal to the National Court of right of asylum (CNDA).

A scenario already possible for foreigners from so-called “

safe

” countries, such as Albania or Georgia, which the government wants to extend to all asylum seekers.

Gérald Darmanin justified this desire by the “

delusional

” journeys of asylum seekers, to whom refugee status is refused in “

70%

” of cases but who can use “

up to twelve procedures

” for appeal.

We are going to reduce the delays

”, insisted the Minister of the Interior, who wishes in parallel a reform of the administrative justice, “

engorged

” by the litigation of foreigners.

Gérald Darmanin thus wishes to "

give asylum more quickly to people who really need it

" and "

to say no very quickly to people we don't want

".

The tenant of Place Beauvau responds to a request from President Emmanuel Macron, who had already announced before the presidential election that he wanted to strengthen the means of removing foreigners who have had their asylum application rejected, by ensuring that "

the refusal of asylum will be worth an obligation to leave French territory

”.

"

It is not reasonable to irregularize the tens of thousands of asylum seekers rejected by the Ofpra (and) who seize the CNDA

", commented to AFP Serge Slama, professor of public law at the Grenoble Alpes University.

"

This will deprive them of the right to maintenance, of the right to material reception conditions and clog the administrative courts because they will be seized of requests for a stay of the OQTF

", he added, castigating a "

gas plant

".

Last year, more than 103,000 asylum applications were submitted to Ofpra.
