A meeting that was actually planned as a conversation turned out to be a trap in Penzberg: An 18-year-old suffered serious head injuries and was in the hospital for five days.

Penzberg – They were allegedly temporarily made compliant by a young man with KO drops or their health was damaged: That is why two girls and the friend of one of the two decided in October last year to confront the alleged culprit.

The three of them arranged to meet, with one of the accused acting as a decoy.

This pretended to the injured party that she wanted to meet him alone.

On the way to the meeting point, however, a much larger group of young people from the Penzberg area quickly gathered.

Judge Claudia von Hirschfeld was sure that the act was planned: "For me, that gives a conclusive picture."

A decoy waited on the mountain dump for the victim - then the beatings followed

Six to eight young people went to the Penzberger Berghalde, with all but the decoy hiding behind a chapel.

When the young man finally appeared, everything happened very quickly: the friend of one of the girls, who also admitted his guilt right at the beginning of the trial, rushed towards the victim and immediately punched him twice in the face.

The rest of the group formed around him at a certain time, and he was constantly threatened, repeatedly hit and even kicked in the head by the main perpetrator.

His jacket was also searched.

"They said I could go if I confessed everything," he told the court.

The situation was tense, many of those involved said they were overwhelmed themselves.

There was probably no clear de-escalation on the part of the group.

However, some said they intervened to prevent worse things from happening.

Victim was 'fear of death'

The victim had brought a self-heated bottle of mulled wine, believing that he would only meet with the girl.

He was eventually forced to try the hot drink and burned his mouth as a result of the constant stream of accusations about the knockout drops.

He was "scared to death" and wet himself.

When the procedure was over, he should have apologized to the girls before he fled, accompanied by another blow.

The group then largely disbanded.

Young man had to stay in the hospital for five days

With the help of a friend, the victim made it to the local hospital, where the extent of the injuries was revealed: The 18-year-old had numerous abrasions, a fractured nose, jaw problems, swollen lips and a worsening headache.

The young man was hospitalized for five days for observation.

The mental ordeal in particular left its mark on the young man, who was already undergoing psychological treatment.

The judge and the prosecutor agreed that the people pulling the strings knew that there would be a massive "beating".

The already convicted main perpetrator must have tried to defend his girlfriend, moved by a sense of pride and honor.

Two weeks permanent arrest for main perpetrators

In the case of four of the accused, the proceedings were temporarily discontinued, after some lengthy back and forth, against payment of not inconsiderable sums of pain and suffering between 250 and 1500 euros and the completion of community service.

The girl, who was 14 at the time of the crime and who played the decoy, was sentenced to a compensation payment of 600 euros and a weekend in youth detention, despite repeated efforts from her mother.

The main perpetrator is also expected to receive compensation payments of 2,000 euros and two weeks of permanent arrest, both for dangerous bodily harm in combination with coercion.

Judge shocked by the actions of the young people

The apologies of those involved would mean “nothing” to the injured party, he stated in court.

The KO drop allegations were not an issue in the process.

The judge was shocked by the actions of the young people, spoke of considerable "mental cruelty" to the victim and made it clear: "I rarely have anything comparable here." If the 18-year-old main accused had been sentenced under adult criminal law, he would probably have been one and a half years Had to reckon with imprisonment, it was said.
