Can a refusal of an asylum application at first instance be synonymous with automatic expulsion for a foreigner?
The Minister of the Interior, Gérald Darmanin, who is due to introduce a law on asylum and immigration in January 2023, after a debate on these themes in Parliament next November, would like to have this legal mechanism engraved in stone.
He repeated it on Tuesday during a hearing before the law commission of the National Assembly.
“We proposed to the Council of State (…) that when there is a refusal of an asylum application, there should be concomitantly an OQTF (Obligation to leave French territory) which be issued, or in any case a refusal residence permit and a pronounced deportation
," he said.
Concretely, the Minister of the Interior wants to change the law so that a negative opinion from the Ofpra (French Office for the Protection of Refugees and Stateless Persons) is worth an expulsion decision, without even waiting for a possible appeal to the Court. National Asylum Law (CNDA)…
