Werner Krug and his ex-wife divorced in 1988.

Since then he has been paying pension rights.

She dies in 2021 - and Krug should continue to pay.

Guxhagen – Werner Krug from Guxhagen (Schwalm-Eder-Kreis) paid money for his ex-wife, even though she was already dead.

As reported by hna.de, the 76-year-old only got back part of the pension equalization.

"I find it unfair to pay for a dead woman," he says.

Krug was married to his ex-wife from 1970 to 1988.

Since his retirement on October 1, 2010, the retired postal worker had to pay her a pension equalization – initially around 200 euros, in the end around 250 euros, depending on the wage rounds of the postal employees.

"I heard from our daughter about the death of my ex-wife," says Krug.

She died in August 2021. Nevertheless, Krug continued to be deducted from the pension equalization.

Krug contacted a pension advisor in December and went to family court.

The decision was finally made on June 20th and came into effect on August 2nd: The pension rights adjustment was canceled retrospectively as of January 1st.

Krug got the money back by then.

But what about the money that Guxhagener had to pay for his ex-wife last year, even though she was already dead?

The Federal Post Office and Telecommunications Agency, which according to Krug is responsible for him because he was a post office clerk, gives an answer.

"The party liable for compensation can apply to the family court for an amendment to the family court's decision that regulates the pension equalization," explains Jialan Omar, a member of the management team.

"The change is effective from the first day of the month following the application."

Reimbursement of pensions reduced between the date of death and the application is not provided for by law.

In order to provide information about the need for an application, the Federal Institute attaches a leaflet to decisions on pension equalization.

The Deutsche Rentenversicherung Bund is also dealing with Krug's situation - and it's not the first case, as a Kassel pensioner reported back in 2018.

"Pensions are paid on a pay-as-you-go basis, which means current expenses such as pension payments are financed from incoming income such as contributions," explains Gundula Sennewald from the insurance company.

"Unused services benefit the solidarity community."

"I'm not interested in what happened to the money," says Krug.

"But it should be an automatism that the compensation ceases to exist if the ex-partner dies." He has been married again for 22 years.
