The accused has been granted ICAC bail pending his appearance in the Eastern Magistrates' Courts tomorrow (23rd).

Zeng Jinrong said on social platforms that he was detained at the airport when he left the country with a diving group

Tsang Kam-wing was prosecuted by the Independent Commission Against Corruption earlier for allegedly violating the Elections (Corrupt and Illegal Conduct) Ordinance, and was subsequently granted bail.

He said in a post on FB today that he was detained by the Immigration Department when he left the country at the airport. He said that he was going to take a group to dive overseas, and questioned that the guarantee conditions did not include not being allowed to leave Hong Kong.

2020 Legislative Council Election Social Welfare Candidates

The ICAC pointed out that the defendant, Tsang Kam-wing (28), a candidate for the social welfare sector in the 2020 Legislative Council election, was charged with one count of fraudulent conduct of submitting false or misleading election returns, in violation of the Election (Fraud and Illegal Conduct) ) Ordinance; and an attempt to defraud, contrary to section 16A of the Theft Ordinance.

The defendant submitted a nomination form to the Registration and Electoral Office on July 30, 2020, to run for election in the social welfare sector in the 2020 Legislative Council Election.

The election was originally scheduled to be held on September 6 of that year. Due to the epidemic, the government announced on July 31 that the election would be postponed for one year.

Pursuant to the Emergency (Date of General Election) (Seventh Legislative Council) Regulation and the Elections (Corrupt and Illegal Conduct) Ordinance, candidates, including the accused, must submit their application to the election on or before 29 September 2020 Submission of election returns by the Office.

The election return must list all the election expenses and election donations of the candidate in the election.

After the government announced the suspension of the 2020 Legislative Council elections, the defendants have the right to apply for money from the government.

He submitted an election return together with supporting documents and a claim form to the Registration and Electoral Office on September 29, 2020, to apply for government payment.

Section 20 of the Elections (Corrupt and Illegal Conduct) Ordinance stipulates that a candidate who makes a materially false or misleading statement in an election return is guilty of corruption.

One of the charges alleges that the defendant engaged in fraudulent conduct in the 2020 Legislative Council election by making materially statements in an election return that he knew to be false or misleading.

Another charge alleges that the defendant allegedly made false statements to the REO by falsely claiming that he had incurred election expenses by employing an election assistant for $8,000, with intent to defraud and attempting to induce the REO to pay him an allowance of $8,000.

The ICAC received a referral from the Registration and Electoral Office earlier and launched an investigation. After seeking legal advice from the Department of Justice, the case was charged against the candidate today.
