Premeditated murder - this accusation is raised by the co-plaintiff against a 26-year-old driver.
According to the indictment, he ran over three people in Neumünster.
The defense strongly disagrees.
Kiel – In the trial for the death of three pedestrians in Neumünster, the co-plaintiff surprisingly accused a 26-year-old driver of murder.
The defense immediately rejected the application on Thursday.
The geriatric care assistant has to answer to the Kiel district court for a prohibited motor vehicle race.
According to the court, however, a conviction for involuntary manslaughter is also possible.
"The accused is sufficiently suspected of murder," co-plaintiff attorney Atilla A. Aykaç justified his application.
Above all, he referred to a chat history that had just been made available, a possible different interpretation of the tire tracks and statements made by the accused at the scene of the accident.
All of the joint plaintiffs asked for the case to be referred to the Circuit Court of Assizes for murder.
Defense attorney Martin Schaar dismissed the murder charge as "absolutely absurd".
"The application serves nothing other than propaganda" against his client, he said on the sidelines of the hearing.
The public prosecutor's office initially did not comment.
The court wants to comment on October 7, 2022.
The chat history, to which the co-prosecutor relies, shows an "obvious cool-headedness on the part of the accused," said the lawyer.
This allows the co-plaintiffs to conclude that "the accused wanted to intentionally kill a person and make the events look like an accident".
According to the indictment, the man, who was on probation for a drug offense, hit the pedestrian group with his car on January 20, 2021.
A 34-year-old man and his 30-year-old partner died, both police officers.
The 27-year-old sister of the 30-year-old succumbed to her injuries a few days later.
The geriatric nurse was therefore without a driver's license, under the influence of drugs and at least 60 km/h on the road.
