Kicked a dog in the Sbahn, hit a woman and choked helpers - the process for Poinger asylum seekers ended.

Ebersberg – It took a good two years before judge Vera Hörauf was finally able to negotiate the process of a Pakistani asylum seeker.

Because at the previous hearings he was either untraceable or in such bad shape that he could hardly speak.

In April 2019, the 39-year-old kicked a passenger's dog on an S-Bahn from Vaterstetten towards Baldham, punched her in the neck and raised a beer bottle to attack.

A man came to the woman's aid - and was choked by the attacker.

The dog was also mentally damaged

The drunk was arrested by police in Baldham, insulting the officers and threatening to kill them.

An alcohol test revealed a value of 2.57 per mille.

The attacked woman from Garching explained to the court as a joint plaintiff that since this "traumatic experience" not only she but also her pet has been suffering from massive psychological problems.

Since then, her assistance dog, which she needs to participate in public life because of a disturbance in her sense of balance, no longer dares to leave the house, let alone take the S-Bahn.

She could only go for a walk with him in the forest, the witness complained in tears.

She also had a headache for a year and a half after the attack.

Useless emergency calls - police and ambulances turn out in vain

But not only this act was on the agenda for the process: the asylum seeker had repeatedly made emergency calls from his accommodation in Poing in 2021 for no reason: sometimes he called the police and claimed that someone had stolen his watch and damaged his jacket, sometimes it was said he had "illegal substances" found.

When he called, he threatened to kill someone.

In addition, the ambulance service was called out several times because the caller stated that he had injured himself or wanted to harm himself.

When the officers responded to his calls on October 28 last year for the second time on the same day and the man stated that he had taken dozens of sleeping pills in addition to alcohol, they took him to the district clinic for self-harm, where the police officers pinned him to the bed.

Despite the handcuffs, the defendant continued to kick.

Still guilty despite 15 beers

The defendant told the court that he drank 15 beers a day or a little more than a bottle of vodka.

About 30 to 40 times he has been placed in a psychiatric clinic for a day or two because of his alcohol problem.

However, he has now been dry for three months.

He admitted all of the allegations in court.

He agreed to a settlement with the joint plaintiff: 2,500 euros in damages.

He also apologized to everyone involved.

A specialist explained to the court that the accused, despite high blood alcohol levels, was in a state of "moderate alcohol intoxication" for most of the crimes, since he was used to high levels - and was therefore at least less criminally responsible.

Only at the last move out because of the combination of sleeping pills and liquor could he be accused of negligent intoxication and incapacity.

Over two years in prison

Since the asylum seeker came to Germany in 2017, he has been convicted six times, and a suspended sentence of five months is still pending.

Judge Vera Hörauf added this to the procedure for the beer bottle attack and added up the events to a year's imprisonment.

With: "The police and emergency services also have something better to do than check on you several times a day," Hörauf also sentenced him to one year and three months in prison for the eight unnecessary emergency calls, as well as to accommodation in one after the prison rehab.
