A Latina woman is accused of murdering her 3-year-old nephew by throwing him into the water from a Chicago pier

"The aggressor did not try to rescue the victim," the police report. The Prosecutor's Office assures that the woman took the minor from the family home without anyone knowing.

A 3-year-old boy died this Sunday, six days after his aunt allegedly pushed him from a Chicago dock into Lake Michigan on September 19, according to local authorities. 

Victoria Moreno, 34, is accused of throwing Josiah Brown into the water at Navy Pier on East Grand Street.

"The assailant did not attempt to rescue the victim

," police said in a statement. 

The boy was pulled from the water by emergency crews and taken to an area hospital in critical condition.

He was pronounced dead Sunday morning at Lurie Children's Hospital, the Cook County Medical Examiner's Office said.

Moreno was arrested at the scene and charged with attempted first-degree murder and aggravated assault on a child.

She was denied bail at a court hearing Wednesday in which the defense argued that she suffers from mental health problems, the NBC News station in Chicago reported.

Prosecutors say Moreno, who lives in suburban Des Plaines, left the family home with the child without anyone else knowing.

At Navy Pier, the woman allegedly allowed the boy to crawl under a fence that blocked access to the water, but pulled him to safety when she saw people looking at her, prosecutors said.

But when no one was there, she climbed over the fence and pushed him off the dock, causing him to fall six feet into the water, according to prosecutors.

The boy was in the water for 30 minutes, until rescue teams found him.

The Cook County State's Attorney's Office said in a statement Monday that the charges against Moreno have so far not changed following the boy's death.

"We anticipate that additional charges may be filed after the medical examiner's office and police department have completed their investigations," it added in a statement.
