A car accident that is also a work accident may give you a very high compensation.

This is what happened to A, a young man from Jerusalem in his twenties, who finished a routine work day at his workplace.

A got on his bike and started riding it on the way home, when suddenly, while riding, he fell off his bike.

Without noticing, A hit a pedestrian who was passing in the crosswalk and as a result flew off the bike.

However, unfortunately for A, it does not end here.

A private vehicle passing by on the road hit A and disappeared from the scene.

Before disappearing, the driver of the offending vehicle called an ambulance to the scene of the accident.

A. was left on the road bleeding and in pain and suffered a severe fracture that required surgery.

A's mistake - he applied himself to the National Insurance

as someone who is used to being independent in the field and always acting on his own, A did not linger too long, and shortly after the accident he applied to the National Insurance Institute.

Since the accident occurred on the way back from work, A claimed that the incident was a work accident and demanded to be paid the compensation he deserves.

Following his application to the National Insurance, A was determined to have a disability of only 10% for the fracture he suffered from.

"At this point, we entered the picture," says attorney Yedidia Loygrund, who specializes in car accidents and represented A. "We filed an appeal on his behalf with the National Insurance, in which we claimed that the actual damage caused to A is significantly more severe than the disability that was determined for him.

" In Loygrund he accompanied A to the medical committees of the National Insurance and stood up for his rights, A was given an increased disability of 19% which was reflected in a one-time grant of several hundred thousand shekels.

"Later," continues Loygrund, "we filed a claim on A's behalf with 'Karnit' - the fund established to ensure compensation for victims of road accidents who cannot receive compensation from the insurance company. In this case, it was necessary to file a claim with 'Karnit' because it was not known who The offending driver, as mentioned, fled the scene of the accident."

Compensation of half a million shekels from "Karnit"

in court "Karnit" disclaimed responsibility.

According to her, A was not injured at all in a car accident, since the main injury that happened to him resulted from the fall caused when he hit a pedestrian and not from the impact of another vehicle, and hence the incident should not be recognized as a car accident and she is not liable for compensation.

"We were not impressed by this, and after investigating the case in depth, we were able to prove in court that the nature of the injury caused to A - a crushing injury to the ankle - was caused as a result of him being run over by a vehicle and not as a result of falling from the bicycle," says attorney Bluygrund. "Consequently, A. received compensation of over half a million shekels."

According to attorney Loygrund, several important things can be learned from the incident regarding a car accident that is also a work accident: First, it is not recommended to contact the National Insurance on your own but through a professional and experienced lawyer who knows the medical and legal umbrella , otherwise the applicant may lose his rights.

Second, you should know that when you are involved in a car accident that is also a work accident - whether the accident occurs while at work or it happens when you are on your way to work or on your way back from it - you are entitled to increased compensation.

That is, not only to receive compensation from the National Insurance, but also to receive compensation due to the traffic accident.

If it is not a car accident, it may be a tortious event for which you can also file a claim.

In the event that it is a car accident that is also a work accident, you must act differently from a standard accident.

You must conduct a procedure to exhaust your rights with the National Insurance and at the same time file a claim for the traffic accident.

The close support of a lawyer will allow you to know when to take each of the procedures, what evidence you must collect and how you should proceed.

This information is valuable and may lead to huge financial savings.
