The Mental Health Forum association: the government did not advance the issue contrary to what was said • Angry: "The treatment of the mentally disabled is against the law" • Ministry of Health: We will fulfill our commitment

After about a year ago the High Court of Justice approved the increase in rent assistance for mentally ill people, an update was recently submitted to the court, which complained that the Ministry of Health had not yet paid this amount, and that the government ministries had not advanced the issue - contrary to their commitment. The petition was submitted on behalf of the Health Forum Association The soul, the Shama Association, the Nahariya Parent Center, the Reot Association and the Anush Association.

Office of

Friedman, Abramson & Co. represented the petitioners.

Difficulty transferring the payment

As I recall, the High Court of Justice decided last September that it would not be able to return and discuss the procedure again, but criticized the ministries and their conduct, and ordered them to establish a policy on the issue. The Ministry of Health violates its commitment, and that, contrary to the respondents' notice, following which the judgment canceling the petition was issued, the aid outline has not yet been drawn up and the aid has not yet been given.

"The respondents were asked to respond to this notice and confirmed, in their notice dated March 24, 2022, that a difficulty arose in transferring the payment of the designated assistance from the Ministry of Health to those recovering. This is because the Ministry of Health lacks an operational mechanism for transferring such current payments, and the Ministry of Construction and Housing, which was requested to make the aforementioned mechanism available to the Ministry of Health , opposed this, and claims that this would require the development of an appropriate platform at a cost that should be covered by the Ministry of Health."

It was further stated that "the Ministry of Construction and Housing estimated that the outline would be implementable within six months from the date of receiving the designated employee assigned to the subject. Accordingly, the finance officials turned to the Finance Committee to obtain its approval for the transfer of the standard between government ministries, and the issue will come before the Finance Committee, after its meeting will be approved by the Agreements Committee, against the background of the election period."

"The mechanism will be implemented as soon as possible"

The Ministry of Health responded: "The treatment of the mentally challenged and their integration is an important and central issue in the actions of the Ministry of Health. The Ministry, in cooperation with other ministries, created a direct payment mechanism for the eligible and is promoting its implementation as soon as possible, as promised."

The Ministry of Construction and Housing responded: "As reported to the court, in the estimation of the Ministry of Construction and Housing, it will be possible to implement the mechanism within six months from the date of receiving a designated employee who will be assigned to the issue, as well as the transfer of the required budget."

Attorneys Gabriel Disney and Yonatan Friedman from the Sh.

Friedman, Abramson & Co., who represented the petitioners, said: "The Supreme Court put the Ministry of Health in its place, and made it clear that its treatment of mental disorders in Israel is both contrary to the law and characterized by intolerable foot-dragging.

"One must wonder how the ministry invests hundreds of thousands of shekels in a television advertising campaign aimed at promoting the mentally disabled in the population, while it itself does not do the minimum required to achieve the same goal. This intolerable behavior indicates a total failure on the part of the ministry in the field of mental health, and it is expected of the ministry that He will work for this special population even more from here on out."
