The Wolfratshausen black buildings have now also reached the petition committee of the state parliament.

He is in favor of giving the tenants a year to find a new place to live.

– The illegal buildings in Wolfratshausen were a topic in the state parliament's petitions committee yesterday.

The three rented single-family houses are to be demolished at the behest of the district office.

The client from Geretsried not only defended himself against this decision in court – but also with a complaint that he submitted to the committee.

But he cannot expect any help from the committee.

The Petitions Committee is campaigning for the tenants.

Clandestine buildings in Wolfratshausen have to be demolished

According to Maya Mantel, head of the district building authority, the buildings at Isarspitz 24, 24a and 25 deviate completely from the building permit originally issued.

Mantel received backing from the Administrative Court and the Administrative Court.

Both dismissed the lawsuit of the client in unison, who later wanted to obtain a building permit for the three single-family houses.


The members of the Petitions Committee discussed the Isarspitz cause for half an hour.

The CSU MP Benjamin Miskowitsch had already emphasized in advance: On the one hand, the case was "legally decided".

On the other hand, the city of Wolfratshausen rejects the subsequent change in the development plan.

In other words, the Petitions Committee cannot force the municipality to create building permits.

Miskowitsch's suggestion: give tenants a year to look for new housing

The proposal that Miskowitsch submitted to the committee: Starting today, the three tenants will be given one year to find new housing.

The stipulation - "and this is to be understood as an urgent appeal" - to the district building authority is: The demolition order should include October 1, 2023 as the date.

The Lower Building Inspectorate is not necessarily bound by this requirement, but Miskowitsch, with a view to tenant protection, assumes that the district building authority will not turn a blind eye to the appeal.

The vote of the committee was unanimous.


Demolition of single-family homes "inevitable"

The demolition of the single-family homes is most likely "inevitable," says Miskowitsch.

Unless there would be a change of heart in the city council and a development plan would be drawn up for the properties in question.

However, Miskowitsch considers this unlikely in view of an unequivocal statement from the town hall.


A second possible option: the lower building control authority could check again whether the houses can be reduced to a permissible level.

This has so far been categorically ruled out by both the head of the district building office and district administrator Josef Niedermaier.

The client, according to Niedermaier, "grossly disobeyed the law" and said "that he will get away with it".


The year's grace period for the residents of the houses also applies to the builder, who collects another twelve months' rent.

“We have to accept that,” admits Miskowitsch.

But it is primarily about the tenants.

"The three families are the least responsible for the misery, they didn't know that they were being rented out from illegal buildings." The client, who had already had to pay a fine of 50,000 euros, was concerned with the imminent demolition of his property (according to him, the Geretsrieder invested around 2 .5 million euros) "already severely punished".

The district office is still reluctant to react to the committee's stipulation.

The builder did not comment on request.

If he is served with a demolition order, he can appeal.
