Rubinstein will hold the position temporarily, after the High Court invalidated the appointment of retired Chief Justice Meni Mazuz, as revealed in "Israel Hayom" • This paved the way for the appointment of Hertzi Halevi to the position of Chief of Staff

The government approved this evening (Wednesday) in a telephone poll the appointment of retired Supreme Court judge Eliakim Rubinstein to the position of chairman of the advisory committee for appointments to senior positions. This paved the way for the appointment of Herzi Halevi to the position of Chief of Staff.

Rubinstein will hold the position temporarily, for the purpose of examining the appointment of the Chief of Staff only, after the High Court invalidated the appointment of the retired Chief Justice Meni Mazuz for an eight-year term as chairman of the committee.

The judges, who accepted the petition submitted by the "Lavi" organization in the matter, determined that it is unlikely that a transitional government would make a critical appointment for such a long term.

They suggested to the ombudsman, Gali Beharve-Miara, to appoint Mazuz only temporarily for the purpose of appointing the Chief of Staff, but Beharve-Miara refused to accept their recommendation, as did Mazuz who demanded to be appointed to the position of salary bearer for a period of eight full years.

Submitted Mazuz's name.

It should be noted that when Beharev-Miara was a candidate for the position of ombudsman, she submitted Mazuz's name as one of her three recommenders, as was first revealed in "Israel Hayom". - Miara, contrary to what the latter claimed in her application forms.

As part of the reasons for the disqualification of the appointment of Mazuz put forward by Judges Solberg, Liner, and Ronan, it is written that "although on the principle level, according to the ruling and in accordance with the directive of the Ombudsman, there is a possibility to order a permanent appointment even during an election period - it must be remembered that the starting point in this context is to avoid as much as possible Appointments.

Even when there is a specific need for a necessary appointment, a temporary appointment should be preferred over a permanent appointment, except for exceptional cases that are exceptions." They further added that "the respondents on behalf of the government turned the exception into the rule and the rule into the exception."

In the meantime, Defense Minister Benny Gantz today forwarded to the committee chaired by Judge (retired) Eliakim Rubinstein, a request to approve the candidacy of the Deputy Chief of Staff, Major General Herzi Halevi, for the 23rd Chief of Staff of the IDF. The required documents were attached to the request in accordance with the government's decision. This is after the appointment of Judge Rubinstein as chairman of the committee was approved by the government.
