In almost all cases where a medical malpractice claim is filed, the insurance company or the hospital conditions the settlement on secrecy and confidentiality since the policy is that the name of the negligent doctors will not be revealed to the public.

In most cases, the plaintiffs and their lawyers are forced to agree to this condition because they prefer the money.



In this case as well, the Hadassah Mount Scopus Hospital in Jerusalem tried to prevent the publication, even after a verdict was given, but the plaintiff and the lawyers went "to the end" and asked the court to approve the publication of the names of the doctor who treated her and the midwife, who were negligent.

All the attempts of the hospital and its attorney to prevent the publication of the names were in vain (even though they were not sued directly but appeared as witnesses for the lawsuit).



The hospital tried to argue that "taking into account the results of the verdict, according to which the defendant (Hadasa) was charged solely due to an engagement between the plaintiff and the defendant's midwives, it is not appropriate that all of the defendant's doctors who testified in the hearings, or whose names were mentioned in the verdict, should be searched. This , due to the possibility of harming their privacy, when the degree of severity required according to this section is left to the discretion of the court."



As mentioned, the court rejected these claims and ordered the publication of the verdict, including the names of the anesthesiologist Dr. Amir Lavi and the midwife Asanat Bar Yosef.



This is a lawsuit concerning a woman giving birth at Hadassah Mount Scopus Hospital, who asked the plaintiff to quickly vacate the delivery room to make room for a new birth. And so she urged her to get out of bed even though she was still under the effect of an epidural. The woman fell while trying to get off and suffered an orthopedic disability. Because of this, the court awarded her compensation of approximately NIS 750,000.



According to lawyers Dr. Assaf Posner and Gilad Lesser, who represented the plaintiff, "Hadassa's attempts to make considerable efforts to prohibit the publication of the names of its staff, while attempting to ride on the fact that the law requires the plaintiff's name not to be disclosed, therefore the judge allowed the publication of the identifying details of The plaintiff, came up in vain.

Hadassah tried to claim that the privacy of the staff members would be compromised, when in practice - the only privacy that would be compromised is the fact that whoever reads the verdict will know that they were negligent.

Instead of drawing lessons for the future, Hadassah is trying to hide what happened."
