After the decision in Shikli's case, the Legal Adviser to the Government submitted to the Central Elections Committee her position regarding the requests to prevent Balad and Ra'am from running in the elections. According to her, there is nothing in the chain of facts underlying the request submitted to the Elections Committee to justify the disqualification of the lists from the Knesset candidates.
The legal adviser to the government stood by the response she submitted about the inherent difficulty in Balad's platform and the evidence accumulated over the years regarding the denial of the existence of the State of Israel as a Jewish and democratic state by the party.
At the same time, she clarified that "even though Balad Odeh is close to the forbidden area that a list out of which cannot compete in the Knesset elections, no evidence has been brought forward that in recent years Balad has worked to remove the hardened parts of its platform from force." Therefore, she believes that the evidence presented in the request for disqualification is not sufficient to meet the strict and stringent standards established for the disqualification of a list in accordance with the law.
At the same time, the chairman of the state camp, Defense Minister Benny Gantz, decided this morning that all representatives of the state camp in the election committee will vote in favor of disqualifying BLD from running for the Knesset.
Gantz claimed that beyond any political consideration there is a value position that cannot be ignored.
Therefore, a list that works against the Jewish nature and against the democratic nature of the State of Israel should not compete in the Knesset.
Over the years, several applications have been submitted to disqualify Balad, and after the Supreme Court examined the party's platform in relation to the "state of all its citizens", it was decided that this was not enough to prevent it from running in the elections.
